HomeMy WebLinkAbout11118RESOLUTION NO. 11118 A RESOLUTION APPOINTING A MEMBER TO THE LIQUOR AND BEER LICENSING BOARD WHEREAS, pursuant to Section 2 -5 of the Charter of the City of Pueblo, unless otherwise required by law, all boards and commissions shall be appointed by Council for terms specified by Council and members of such Boards are subjected to removal by Council; and WHEREAS, under and by virtue of Section 11- 3 -5(b) of the Pueblo Municipal Code, any member of the Liquor and Beer Licensing Board may be removed by the City Council for nonattendance to duty or for cause and shall be automatically removed for failure to attend three (3) consecutive meetings of the Board; and WHEREAS, City Council appointed Howard Lukenbill to the Pueblo Liquor and Beer Licensing Board for term of August 1, 2004 through August 1, 2008, subject to removal as herein above provided; and WHEREAS, City Council finds and concludes that Howard Lukenbill failed to attend consecutive meetings of the Pueblo Liquor and Beer Licensing Board help July18, 2007, August 1, 2007, August 15, 2007 and September 5, 2007; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Pursuant to Section 11- 3 -5(b) of the Pueblo Municipal Code, Howard Lukenbill is automatically removed as a member of the Pueblo Liquor and Beer Licensing Board and said board position is vacated. SECTION 2. Approval of the Resolution inserting the name of one board member. There is a vacancy on the Liquor and Beer Licensing Board due to the removal of Board Member Howard Lukenbill. Under and by virtue of Section 11- 3-5(b) of the Pueblo Municipal Code, any member of the Liquor and Beer Licensing Board may be removed by the City Council for nonattendance to duty or for cause and shall be automatically removed for failure to attend three (3) consecutive meetings. Due to illness, Howard Lukenbill failed to attend consecutive meetings held on July 18, 2007, August 1, 2007, August 15, 2007 and September 5, 2007 and pursuant to said Section, Mr. Lukenbill is automatically removed from the board. Individuals who had submitted questionnaires during the last recxuitrnent process (July, 2007) were each contacted and asked if they wished to be considered again for appointrnerrt An advertisement seeking other volunteers to serve on this board was published in The Pueblo Chieftain on Sunday, September 9, 2007 and the following questionnaires were received: APPLICANTS: Linda L DeNiro (resident) Derrick L Padift (resident) Tammy Larsen (resident) Greg L Smith (resident) Howard Lukenbill (resident) Verna Vidana (resident) Barbara Martinez (non - resident) Landes L Ianotalli (resident) John Musso (resident) FINANCIAL IMPACT None
