A RESOLUTION TRANSFERRING A CITY PARCEL OF LAND TO THE COLORADO
DEPARTMENT OF TRANSPORTATION FOR ROADWAY WIDENING PURPOSES
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Quit Claim Deed, dated August 13, 2007 from the City of Pueblo, a Municipal
Corporation (Grantor) to the Colorado Department of Transportation, a copy of which is
attached hereto, having been approved as to form by the City Attorney, is hereby approve. The
President, of City Council is authorized to execute and deliver the Quit Claim Deed in the name
of the City and the City Clerk is directed to affix the seal of the City thereto and attest same.
SECTION 2.
The City Clerk is directed to cause said Quit Claim Deed to be recorded in the office of
the Pueblo County Clerk and Recorder.

TITLE
A RESOLUTION TRANSFERRING A CITY PARCEL OF LAND TO THE COLORADO
DEPARTMENT OF TRANSPORTATION FOR ROADWAY WIDENING PURPOSES
ISSUE
Should the City Council transfer a city owned parcels of land to the Colorado Department of
Transportation for roadway widening purposes at the intersection of Joplin Avenue (SH227) and Portland
Avenue for improvements associated with the River's Run Subdivision.
RECOMMENDATION
Approval of this Resolution
BACKGROUND
The approval of the River's Run Subdivision requires the developer to improve the intersection geometry
at Joplin Avenue (SH227) and Portland Avenue to accommodate the increased traffic volumes generated
by the development. The widening of the intersection encroaches into a City owned parcel, In order for
construction to continue the parcel will need to be transferred to the Colorado Department of
Transportation.

FINANCIAL IMPACT
There is no financial impact to the City of Pueblo due to this action.

THIS DEED, Made this 13` day of August, 2007, between the City of Pueblo, a Municipal Corporation grantor,
and Colorado Department of Transportation whose legal address is 4201 E. Arkansas Avenue, Denver, CO 80222
of the County of Denver, and State of Colorado, grantee,
WITNESSETH, That the grantor for and in consideration of the sum of One Dollar and other good and
valuable consideration the receipt and sufficiency of which is hereby acknowledged, has remised, sold, conveyed
and QUIT CLAIMED, and by these presents does remise, release, sell, convey and QUIT CLAIM unto the
grantee, its successors and assigns, forever, all the right, title, interest, claim and demand which the grantor has in
and to the real property, together with improvements, if any, situate, lying and being in the County of Pueblo and
State of Colorado, described in Exhibits A and B attached hereto and incorporated herein.
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and privileges
thereunto belonging or in anywise thereunto appertaining, and all the estate, right, title, interest and claim
whatsoever, of the grantor, either in law or equity, to the only proper use, benefit and behoof of the grantee, its
successors and assigns forever.
IN WITNESS WHEREOF, The grantor has executed this deed on the date set forth above.

A parcel of land lying within a portion of the NE 1/4 of Section 6, Township 21 South,
Range 64 West of the Sixth Principal Meridian, being more particularly described as
follows:
A parcel of land for the purpose of public right of way being more particularly described
as follows:
BEGINNING at a point on the westerly right -of -way line of U.S. Highway No. 227 from
which the NE corner of said Section 6 bears N51' 11'02 "E, (bearings based on the line
between the said NE comer of Section 6, also known as Pueblo County GPS Monument
No. 1405, being a lead plug and tack in a stone, in a cast iron monument box, and Pueblo
County GPS Monument No. 7, being a No. 7 rebar, to bear SO4 °32'49 "E, based on the
Colorado State Plane Coordinate System, South Zone) a distance of 38.60 feet; thence
S00° 10'38 "W along the said westerly right -of -way line of U.S. Highway No. 227, a
distance of 35.00 feet; thence N26 °23'53 "W, a distance of 43.74 feet to a point on the
said westerly right of way of U.S. Highway No. 227; thence S77 °55'33 "E along said
