A RESOLUTION ACCEPTING CONVEYANCE OF LAND BY QUIT CLAIM DEED FROM
OWNERS OF REAL PROPERTY, 2800 S. PRAIRIE AVENUE OF PUEBLO, COLORADO
WHEREAS, the quit claim deed is necessary to widen the intersection of Prairie Avenue
and Pueblo Blvd associated with the La Bella Piazza Subdivision.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Quit Claim deed dated June 27, 2007, a copy of which is attached hereto, having
been approved as to form by the City Attorney, is herby approved and accepted.
SECTION 2.
The City Clerk is directed to cause said Quit Claim Deed to be recorded in the office of
the Pueblo County Clerk and Recorder forthwith.

ISSUE
Should the City accept a deed from the property owners of 2800 S. Prairie Avenue for right -of -way.
Approval of this Resolution
BACKGROUND
The approval of the La Bella Piazza Subdivision and the construction of Lowe's within the subdivision
requires the developer to widen the intersection of Pueblo Blvd (SH45) and Prairie Avenue to
accommodate the increased traffic volumes generated by the development. The widening of the
intersection necessitated the developer acquire additional property from private property owners on the
northwest, northeast and southeastern corners of the intersections. The acceptance of the deed is
necessary for the developer to construct required improvements.

FINANCIAL IMPACT
There is no financial impact to the City of Pueblo due to this action.

address is MAC C7300 -120, 1740 Broadway, Denver, Colorado of the City and County of

described as follows:
COMMENCING at the Northwest corner of said Lot 7, said corner also being the
Southeast intersection of Pueblo Boulevard and South Prairie Avenue; thence South 00 °20'56"
East along the East Right -of -way line of said South Prairie Avenue a distance of 65.35 feet to
the POINT OF BEGINNING; thence North 84 °39'04" East a distance of 20.08 feet; thence
South 00 °20'56" East a distance of 148.95 feet to a point on the South line of said Lot 7;
Thence North 72 °17'25" West along said South line of Lot 7 a distance of 21.04 feet to the
Southwest corner thereof, said comer being on the East Right -of -way line of said South Prairie
Avenue; thence North 00 °20'56" East along said East Right -of -way line a distance of 140.68
feet to the POINT OF BEGINNING.
Containing: 2,896 square feet (0.07 acres) more or less.
A drawing showing the Real Property that is being conveyed is attached hereto and
incorporated herein by reference as Exhibit A.
With all it appurtenances and privileges thereunto belonging or in anywise hereunto
appertaining, and all the estate, right, title, interest and the claim whatsoever of the Grantor
either in law or equity, to the only proper use, benefit and behalf of the Grantee, and its
successors, and assigns forever.
