A RESOLUTION ACCEPTING CONVEYANCE OF LAND BY QUIT CLAIM DEED FROM
OWNERS OF REAL PROPERTY, 2727 S. PRAIRIE AVENUE OF PUEBLO, COLORADO
WHEREAS, the quit claim deed is necessary to widen the intersection of Prairie Avenue
and Pueblo Blvd associated with the La Bella Piazza Subdivision.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:

The Quit Claim Deed dated June 19 2007, a copy of which is attached hereto, having
been approved as to form by the City Attorney, is herby approved and accepted.

The City Clerk is directed to cause said Quit Claim Deed to be recorded in the office of
the Pueblo County Clerk and Recorder forthwith.

TITLE
A RESOLUTION ACCEPTING CONVEYANCE OF LAND BY QUIT CLAIM DEED FROM
OWNERS OF REAL PROPERTY, 2727 S. PRAIRIE AVENUE OF PUEBLO, COLORADO
ISSUE
Should the City accept a deed from the property owners of 2727 S. Prairie Avenue for right -of -way.
RECOMMENDATION
Approval of this Resolution
BACKGROUND
The approval of the La Bella Piazza Subdivision and the construction of Lowe's within the subdivision
requires the developer to widen the intersection of Pueblo Blvd (SH45) and Prairie Avenue to
accommodate the increased traffic volumes generated by the development. The widening of the
intersection necessitated the developer acquire additional property from private property owners on the
northwest, northeast and southeaster corners of the intersections. The acceptance of the deed is necessary
for the developer to construct required improvements.

FINANCIAL IMPACT
There is no financial impact to the City of Pueblo due to this action.

Know all Men by these Presents, That WRB Trust and DLB Trust ( "Grantor ")
whose address is 2 Windbridge Lane, Pueblo, Colorado of the County of Pueblo and State of
Colorado, for the consideration of THREE THOUSAND TWO HUNDRED NINETY NINE
AND 99/100 DOLLARS ($3,299.90) and other good and valuable consideration, in hand paid,
hereby sells, releases and QUIT CLAIMS to CITY OF PUEBLO, a Municipal Corporation,
of the County of Pueblo and State of Colorado ( "Grantee "), whose mailing address 1 City Hall
Place, Pueblo, Colorado 81003, the following Real Property situate in the County of Pueblo
and State of COLORADO. to wit:
A parcel of land being a portion of PARCEL ID # 1515400001 located in the Southeast
Quarter of Section 15, Township 21 South, Range 65 West of the 6 P.M., County of
Pueblo, State of Colorado being more particularly described as follows:
BEGINNING at the Northeast corner of said Parcel, said corner being the Southeast
corner of Parcel C, Rearrangement of Property Boundaries of Lots 3, 4 and 5, Block 1,
South Park Business Subdivision; thence South 00 °20'56" East along the West R.O.W.
line of South Prairie Avenue a distance of 209.35 feet; thence South 59'39'19" West a
distance of 8.08 feet; thence North 00 °20'56" West along a line parallel with and 7 feet
westerly of said West R.O.W. line a distance of 209.34 feet to a point on the North line
of said Parcel and a point on the South line of said Parcel C; thence North 59 °35'29"
East along said North line and said South line a distance of 8.09 feet to the Northeast
corner of said Parcel and the Southeast corner of said Parcel C and to the POINT OF
BEGINNING.
Containing: 1,465 square feet (0.03 acres) more or less.
A drawing showing the Real Property that is being conveyed is attached hereto and
incorporated herein by reference as Exhibit A.
With all it appurtenances and privileges thereunto belonging or in anywise hereunto
appertaining, and all the estate, right, title, interest and the claim whatsoever of the Grantor
either in law or equity, to the only proper use, benefit and behalf of the Grantee, and its
successors, and assigns forever.
