HomeMy WebLinkAbout11020RESOLUTION NO. 11020 A RESOLUTION APPROVING AN AGREEMENT FOR TRANSFER OF ENTITLEMENTS BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE U.S. DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION, AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME Whereas, the City of Pueblo borrowed entitlements from the City of Fort Morgan, Colorado for projects at the Pueblo Memorial Airport; and Whereas, the City of Fort Morgan, Colorado is now in need of the entitlement funds; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. A certain Agreement for Transfer of Entitlements, a copy of which is attached hereto and made a part hereof by reference, after having been approved as to form by the City Attorney, by and between the City of Pueblo, a Municipal Corporation, and the U.S. Department of Transportation Federal Aviation Administration is hereby approved, subject to the conditions as set forth in said Agreement for Transfer of Entitlements. SECTION 2. The President of City Council is hereby authorized to execute said Agreement for Transfer of Entitlements on behalf of Pueblo, a Municipal Corporation. RECOMMENDATION Approval of this Resolution. BACKGROUND The Pueblo Memorial Airport is guaranteed $150,000 in entitlement funds from the US- DOT FAA each year. In 2006, the Airport needed additional funds to improve the Runway 35 safety area by relocating a portion of William White Boulevard. The FAA determined that the City of Fort Morgan had not used their 2006 entitlements and asked them to transfer their entitlements to Pueblo, which they did. Now the City of Fort Morgan is in need of additional funding and, therefore, the FAA has requested that the City of Pueblo transfer its 2007 entitlements to Fort Morgan. FINANCIAL IMPACT None. U.S. Department of Transportation Federal Aviation Administration AGREEMENT FOR TRANSFER OF ENTITLEMENTS In accordance with section 47117(c)(2) of Tide 49 U.S.C. (hereinafter called the "Act "): CITY OF PUEBLO, COLORADO Hereby waives receipt of the following amount of funds apportioned to it for each fiscal year specified under section 47114(c)(1) of the Act. Amount Fiscal Year $150,000 2007 TOTAL $ $150,000 On the condition that the Federal Aviation Administration makes the waived amount available to: CITY OF FORT MORGAN, COLORADO For eligible projects under section 47104(a) Act. This waiver shall expire on earlier of September 30, 2007 or when the availability of apportioned funds would lapse under section 47117(b) of the Act.
