HomeMy WebLinkAbout10968RESOLUTION NO. 10968 A RESOLUTION ESTABLISHING AN APPROVED LIST OF CONTRACTORS TO PERFORM EMERGENCY SANITARY SEWER POINT REPAIRS DURING CALENDAR YEARS 2007 AND 2008 AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE CONTRACTS WITH THE SAME WHEREAS, proposals for PERFORMING SANITARY SEWER POINT REPAIRS under Project No. 07 -007 have been received and examined, and; WHEREAS the proposals from PATE CONSTRUCTION, PARKER EXCAVATING, INC., K.R. SWERDFEGER CONSTRUCTION, INC., AND 144 CONSTRUCTION CORPORATION (collectively the "Approved List") have been determined to be responsive; BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 Council hereby authorizes, subject to an unexpended balance of appropriations therefore, that upon approval of the City Manager contracts for effecting emergency sanitary sewer point repairs may be awarded from time to time, to the lowest bidder on the Approved List, as determined by unit prices for elements of construction submitted by responsive bidders under Project No. 07 -007, based on the requirements and unit quantities of each repair project as may arise, and that the same be awarded to said bidder in the required amount at the time of each project. SECTION 2. The Purchasing Agent is hereby authorized to execute each said contract on behalf of Pueblo, A Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 3. Funds for each said project shall be from the unexpended balance of appropriations for emergency sanitary sewer point repairs in the Sewer User Fund. ISSUE Should the City Council establish a list of qualified contractors to perform point repairs to sanitary sewers during calendar years 2007 and 2008, selecting the lowest bidder for each project based on unit prices submitted by bidders under Project No. 07 -007 and the unit quantities for each point repair? RECOMMENDATION Approve this Resolution. BACKGROUND The City of Pueblo owns and operates a sanitary sewer system for the purpose of conveying sanitary sewage to the James R. Dilorio Water Reclamation Facility for treatment and disposal. Portions of the sanitary sewer system are more than 100 years old, and were constructed using clay tile pipe. From time to time the City discovers broken pipes or obstructions in pipes that cannot be cleared. In such emergency cases, point repairs must be made in an expeditious manner by excavating and replacing the damaged sanitary sewer pipes. Sanitary sewer problems requiring point repairs are most often discovered when residents report service problems. As a result, it is often not possible to anticipate when and where point repairs will be needed. Between the time that the problem occurs and the time it is repaired, homes in the vicinity may be without sanitary sewer service or be at risk of sanitary sewer backups. As a result, it is in the best interest of the community that sanitary sewer point repairs be completed as rapidly as possible after discovery. The City of Pueblo normally requires competitive bids for construction projects in order to assure that costs are controlled. The City also has provisions that allow the City Manager to approve emergency construction projects without bidding and without prior City Council approval. Nevertheless, invocation of the emergency provision circumvents the competitive bidding process. This resolution, authorizing contracts under Sanitary Sewer Point Repair Project 07- 007, will provide both competitive bid cost controls and rapid response capability by establishing a list of qualified contractors who have provided a list of unit prices. The Purchasing Department solicited unit cost competitive bids from contractors for various elements of sanitary sewer point repair, including per - linear -foot pipe replacement costs for differing pipe sizes and depths, unit costs for manholes, unit costs for curb - and -gutter repair, and mobilization costs. Four bids were received. A bid summary sheet is attached. The four responsive bidders form a list of qualified firms to whom point repair projects can be offered. When a point repair project arises, Wastewater Department staff will evaluate the repairs needed, determine the unit quantities for the work required and determine which of the qualified vendors would be able to effect the repairs at the lowest cost by using the unit prices provided by each vendor in their bid. The point repair will then be offered to the vendor providing the lowest cost. The vendor will be required to sign a standard City construction contract for each project. The project will then proceed immediately without further Council action. FINANCIAL IMPACT Funds for this project are available from the Sewer User Fund.
