HomeMy WebLinkAbout10828RESOLUTION NO. 10828 A RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO APPROVE A MODIFICATION TO THE GLEN AT WALKINGSTICK SUBDIVISION TO RESTRICT THE DEVELOPMENT AND THE ISSUANCE OF BUILDING PERMITS ON ALL LOTS WITHIN THE SUBDIVISION UNTIL THE LOTS ARE RESUBDIVIDED BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Director of Public Works is authorized to approve a modification to the Glen at Walkingstick Subdivision ( "Subdivision ") restricting the development and issuance of building permits on lots within the Subdivision until the lots are resubdivided in conformance with Title XII, Chapter 4 of the Pueblo Municipal Code. Such restriction shall be approved as to form by the City Attorney and be placed on the Subdivision Plat and included in the Subdivision Improvements Agreement for the Subdivision. SECTION 2. The Subdivider, Colorado State University System will have no financial obligation relating to the public improvements within the Subdivision unless the Board of Governors of Subdivider (i) declares its intention to assume such financial obligation by resolution duly adopted, (ii) becomes the developer of any lots within the Subdivision, or (iii) becomes the Subdivider of any resubdivision of any lot within the Subdivision. TITLE • RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO APPROVE • MODIFICATION TO THE GLEN AT WALKINGSTICK SUBDIVISION TO RESTRICT THE DEVELOPMENT AND THE ISSUANCE OF BUILDING PERMITS ON ALL LOTS WITHIN THE SUBDIVISION UNTIL THE LOTS ARE RESUBDIVIDED ISSUE Should the City Council authorize the Director of Public Works to approve a modification to the Glen at Walkingstick Subdivision to restrict the development and issuance of building permits on all lots until resubdivision of the lots. RECOMMENDATION Approve this Resolution. BACKGROUND The subdivider of the land, a public entity (Colorado State University System), desires to sell a portion of a larger parcel of land and is required to first subdivide the larger parcel. Colorado State University System has proposed that the larger parcel of land be subdivided without obligation to install public improvements in order to sell a portion thereof. Since the subdivider is a public entity which has master planned a large area around the Walkingstick Golf Course and has in the past subdivided and sold parcels of land in the master planned area, City staff is willing to recommend such a subdivision provided no development is allowed on, nor building permits issued for any lot within the subdivision until such lot is resubdivided in conformance with Title XII, Chapter 4 of the Pueblo Municipal Code. This arrangement is in the nature of an intergovernmental agreement between the City and the Colorado State University System. FINANCIAL IMPACT None.
