A RESOLUTION AUTHORIZING THE ISSUANCE OF A BUILDING PERMIT PRIOR TO
SUBDIVISION AT 320 SOUTH SANTA FE AVENUE PRIOR TO THE RECORDING OF THE AFT
SUBDIVISION
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Due to exigent circumstances, contemporaneously with the filing of a complete subdivision
application meeting all of the requirements of Chapter 4, Title XII of the Pueblo Municipal Code as
determined by the Director of Public Works ( "Subdivision ") for the land located at 320 South Santa
Fe Avenue ( "Property "), the City administration is authorized to approve the issuance of a building
permit for a building or structure to be constructed or installed on the Property ('Building Permit').
SECTION 2.
The Building Permit will be deemed revoked and cancelled if the owner of the Property
does not diligently pursue the Subdivision to final approval. No certificate of occupancy shall be
issued for any building or structure constructed or installed on the Property pursuant to the Building
Permit until after the Subdivision has been approved by City Council and the plat has been
recorded. The conditions, restrictions, and limitations set forth herein shall be incorporated in and
made a part of the Building Permit.

TITLE

ISSUE
Should the City Council authorize the issuance of a building permit to AFT Enterprises, A
Colorado Partnership, prior to the approval and recording of the subdivision.
RECOMMENDATION
Approval of this Resolution
BACKGROUND
In an effort to begin construction of metal storage building, a request has been made for approval
by the City Council to allow staff to sign off on the building permit prior to a recorded
subdivision. This resolution will authorize City administration to approve the issuance of a
building permit prior to City Council approval and subsequent recording of the subdivision plat.
The first reading for approval of the AFT Subdivision is scheduled to be heard on August 14,
2006.
The building permit will be revoked and cancelled if the owner of the property does not
diligently pursue the completion of the subdivision process. No certificate of occupancy shall be
issued for any building or structure associated or installed on the property until after the
subdivision has been approved by City Council and the plat has been recorded.
