A RESOLUTION APPROVING AMENDMENT NO. 1 TO THE AGREEMENT BETWEEN THE CITY
OF PUEBLO, A MUNICIPAL CORPORATION, AND DESIGN STUDIOS WEST, INC., FOR
PERFORMING AND COMPLETING THE CONSTRUCTION DOCUMENTATION AND BIDDING
PHASE SERVICES FOR PHASE III A -1 OF THE HISTORIC ARKANSAS RIVERWALK OF PUEBLO,
AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME
WHEREAS, the City approved an agreement with Design Studios West, Inc. ( "DSW ") on
February 27, 2006 to perform "Part A" of the Construction Documentation and Bidding Phase for
Phase III A -1 of the Historic Arkansas Riverwalk of Pueblo ( "HARP ").
WHEREAS the City now desires to have DSW complete the Construction Documentation and
Bidding Phase for this Phase of HARP; and
WHEREAS, the City of Pueblo and the HARP Foundation have funds available for completion
of the Construction Documentation and Bidding Phase for HARP Phase III A -1; NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO. COLORADO. that:
SECTION 1.
Amendment No. 1 to the Agreement for Professional Design Services dated February 27,
2006, between the City of Pueblo, a Municipal Corporation, and Design Studios West. Inc.
( "Amendment No. 1 "), a copy of which is attached and incorporated herein and having been approved
as to form by the City Attorney, is hereby approved.
SECTION 2.
The President of City Council is hereby authorized to execute and deliver Amendment No. 1 in
the name of and on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix
the seal of the City thereto and attest the same.
SECTION 3.
Funds in the amount of $129,300 will be paid from the HARP Phase III A -1 Capital
Improvement Project No. PWHP07 for performance and completion of the Construction
Documentation and Bidding Phase for Phase III A -1 of HARP.

Should the City Council approve an amendment to the Agreement with Design Studio
West, Inc. to complete the Construction Documentation and Bidding Phase for the
HARP Phase III A -1 project?
RECOMMENDATION
Approve the Resolution.
BACKGROUND
Ordinance No. 7442 established a budget for completing Phase III A -1 of the Historic
Arkansas Riverwalk of Pueblo project. The City divided the Construction
Documentation and Bidding Phase into two parts. The first part, ( "Part A "), is completed
and included the consultant's verifying the site design, identifying the construction
materials, updating the cost estimate, establishing the phasing perimeters and
addressing all of the concerns that the partners have identified. The City is ready to
complete the Construction Documentation and Bidding Phase ( "Part B "). The
construction documents will be completed in June 2006, bidding will take place during
the month of July, and construction should begin in September or October 2006.
Construction will be completed by February 2008.
The City entered into an Agreement for Professional Design Services with Design
Studios West, Inc. on February 27, 2006 to complete "Part A" of the Construction
Documentation and Bidding Phase for the project. This Amendment No. 1 will direct
DSW to complete the Construction Documentation and Bidding Phase for Phase III A -1
of the project.
FINANCIAL IMPACT
The final step, "Part B ", in completing the Construction Documentation and Bidding
Phase will cost $129,300. DSW will be paid from the HARP Phase III Capital
Improvement Project No. PWHP07.
AMENDMENT NO.1
AGREEMENT FOR PROFESSIONAL DESIGN SERVICES
THIS AMENDMENT NO. 1 to the Agreement for Professional Design Services is made
and entered into this 24th day of April 2006 by and between the City of Pueblo, a Municipal
Corporation (hereinafter referred to as "Owner") and Design Studios West, Inc., a professional
planning and design firm (hereinafter referred to as "Consultant ").
WHEREAS, Owner and Consultant have heretofore entered into an Agreement
(hereinafter "the Agreement ") dated February 27, 2006, wherein the Consultant agreed to render
certain professional planning, design, engineering and related services for Owner in connection
with the Historic Arkansas Riverwalk Project, Phase III A -1 (hereinafter referred to as the
"Project"); and
WHEREAS, the parties agree that this Amendment No. 1 to the Agreement is necessary
and desirable to modify the Agreement to provide for the Consultant to perform and complete
the additional design work and preparation of Bid Documents (including Contract Documents,
Plans and Specifications), including all remaining work of the Construction Documentation and
Bidding Phase of the Project and performance of construction administration activities by the
Consultant now remaining with respect to the Project (that is, all services described in
Subsection 2.4 of the Agreement which remain with respect to Phase III of the Project) and to
modify the Agreement to include required provisions applicable thereto;
NOW, THEREFORE, in consideration of the foregoing and mutual terms and conditions
set forth herein, the parties agree as follows:
1. The Agreement is amended by expanding the scope of work to include all professional
planning, design, engineering and related services and functions reasonably required or
necessary for the Construction Documentation and Bidding Phase, as contemplated within
Sections 1 and 2 of the Agreement, as amended, with respect to the Project.
2. Appendix "A" to this Amendment No. I shall be added to the original scope of work,
and the Consultant shall complete the work items described generally in Appendix "A" to this
Amendment No. 1 in accordance with the terms of the Agreement, and all prior amendments
thereto for the performance of professional services with respect to the Project.
3. With respect to services provided under this Amendment No. 1, Appendix `B" to this
Amendment No. 1 shall apply to compensation payable to the Consultant, and to key personnel
and consultants employed or retained by the Consultant, in connection with the Consultant's
services for the work authorized by this Amendment No. 1. The aggregate compensation payable
to the Consultant for performance of the additional services and reimbursable expenses
authorized by this Amendment No. 1 shall not exceed the maximum amount of $129,300.
4. Appendix "C" shall be added to this Amendment No. 1 and identify key personnel
who will be involved in the Project on behalf of the Consultant.
5. Except as expressly modified by this Amendment No. 1, the Agreement, including all
prior written amendments thereto, shall remain in full force and effect. Any obligations
remaining to be performed under the original Agreement (and all prior amendments) by either
party, relating to the professional services to be performed by the Consultant generally or with
respect to other phases of the project are not waived or excused in any manner, but shall be fully
performed in accordance with the terms and conditions of the Agreement as it existed prior to
this Amendment No. 1.
6. The Agreement is amended by the addition of the following subsections 10.3 and 10.4
under Section 10:
10.3 ACCESS TO RECORDS — Consultant shall make available to the City,
Economic Development Administration (EDA), the Comptroller General of the
United States, the Inspector General of the Department of Commerce, or any of
their duly authorized representatives, all documents, books, papers, and records of
the architect/engineer (which are directly pertinent to the HARP project) for the
purpose of making an audit, examination, excerpts, and transcriptions. The
Consultant shall maintain all required records for at least three years after the City
makes final payment and all pending matters are closed.
10.4 Consultant shall comply with all bidding and construction requirements identified
under the City of Pueblo's Economic Development Administration Grant, Award
No. 05 -01- 04239.
IN WITNESS WHEREOF, Owner and Consultant have executed this Amendment No. 1
to the Agreement For Professional Design Services as of the date first above written.

HARP PHASE 111A-1 — Construction Documents
Part B. — Progration of Construction Documents and Bidding Phase
A. PROFESSIONAL SERVICES
Below is the Scope of Work for the preparation of the Construction Documents for HARP Phase
III A -1. The design team is as follows:
Prime Consultant: Design Studios West, Inc.
Subconsultants: Sellards & Grigg, Inc.
HydroSystems *KDI, Inc.
Aqua Engineering, Inc.
Terracon
Project Limits: The project limits arc defined by the attached Project Limits diagram
(Exhibit A).
Definitions: The term "Consultant" shall be used to refer to the Prime consultant and /or
any of the sub - consultants listed herein.
Project Description:
L Design ofNavigable Channel
Consultant shall complete final design of the navigable channel from the point of connection
with the current channel terminus point immediately north of the Grand Avenue Bridge to
the terminus point as shown on the attached project limits diagram (Exhibit A).
The Navigable channel as described above shall include the following elements:
The modification of the wall alignment in the turning basin to provide for curvature
rather than an angle point at the connections between the navigable channel and the
turning basin.
The reinforced concrete channel bottom within the project limits as described in
Exhibit A.
• The reinforced concrete channel walls within the project limits as described in
Exhibit A. The design of channel walls shall specifically include the design of the
coping stone surface that shall be used for the top surface of the wall and any
elevation variations in the top of the channel wall that are determined during the
final design process.
The sub -drain system that serves the entire Phase III navigable channel as described
in Exhibit A.
The reinforced concrete foundation for the Boathouse is not included in the design
for Phase IIIA -1. The consultant shall provide design of the channel walls and
channel floor in the boat storage area to allow for the future removal of the channel
floor to receive the building foundation. It is understood that the channel floor in
the boat storage area will need to be removed and replaced as necessary for the
boathouse structure foundation, which will be constructed in a future phase. The
current design phase will allow for boat storage and the use of a temporary boat
ramp in the Boathouse area.
• The sidewalk adjacent to the navigable channel.
2 Environmental Consulting Services for the Prepamdon ofa Voluntary Cleanup
Program Application
• Consultant shall perform environmental consulting services for a Phase I
Environmental Site Assessment (PHl ESA) and the preparation of a Voluntary
Cleanup Program (VCUP) application. The purpose of the ESA is to assist in the
development of information to identify recognized environmental conditions (RECs)
in connection with the site.
• A Phase II, Environmental Site Investigation (PH2) may be necessary depending on
the findings of Phase I (PHI ESA). If the Phase II investigation is required, a request
for modification to the Agreement would be made with the appropriate costs to
proceed with Phase II.
3. Americans with Disabilides Act (ADA) Compliance
Consultant shall be responsible for the design of all pedestrian walkways within the project
limits of the HARP Phase IIIA -1 project limits to be in accordance with ADA standards.
4 Utility Relocation required for construction of the Phase III -A Navigable Channel
Due to the elapsed time since the completion of the Design development Phase of the
HARP Phase IIIA -1 project, Consultant shall be responsible for placing a request for the
marking of underground utilities with the project limits as described by Exhibit A.
Consultant shall be responsible for surveying ground markings of underground utilities
within the project limits as described by Exhibit A and annotating utility locations on the
construction drawings.

The design of water line relocations required for the construction of the navigable channel.
The design of water line relocation within the limits of Richmond Avenue as shown on the
attached Exhibit A shall be specifically excluded from the scope or services for the HARP
Phase IILA -1 project.
5. Drainage Infrastructure Required for Construction of the Navigable Channel
The final design of storm sewer infrastructure necessary for the construction of the HARP
Phase IIIA -1 project described as follows:
The final design of approximately 90 lineal feet of reinforced concrete pipe that will
ultimately provide for discharge of parking lot overflows for extreme flood events
into the navigable channel. For the interim condition associated with Phase IIIA -1,
the reinforced concrete storm sewer will be terminated and temporarily blocked at a
location south of the exiting flow line of Richmond Avenue so as to avoid disruption
of Richmond Avenue at this location as described on Exhibit A.
The final design of storm sewer connections to the existing sump condition inlets at
the intersection of Richmond and Mechanic that will provide for collection of
stormwater at this location and discharge into the proposed storm sewer that will
discharge to the existing storm sewer trunk line beneath the navigable channel.
The final design of the storm sewer system at the intersection of Richmond and
Mechanic will be a design for an interim condition due to the fact that the existing
vertical alignment of Richmond Avenue is not being significantly changed as part of
the HARP Phase III -A project. The design concept for the interim drainage
condition at the intersection of Richmond & Mechanic will provide sufficient storm
sewer capacity from the sump condition at the intersection to insure that the
stormwater ponding depths at the intersection under the interim condition do not
exceed the ponding depths under the existing condition for a full range of flood
return periods.
• The final design of a storm sewer lateral connecting to the existing sump conditions
on the police department site as described in Exhibit A.
6. Extension of the Raw Water Delivery System to the Navigable Channel
The final design of the extension of the existing raw waterline that currently conveys raw
water from Lake Elizabeth to a point of discharge in the navigable channel under the Grand
Avenue Bridge. The design of the raw water line extension shall specifically include the
development of the horizontal and vertical alignment of the pipe from the point of
connection with the exiting raw water line under the Grand Avenue Bridge to the point of
discharge into the navigable channel near the upstream terminus of the navigable channel.
The raw water line extension shall include valves that will allow for control of discharge to
the navigable channel at the existing point of discharge under the Grand Avenue Bridge and
at the new point of discharge near the upstream terminus of the navigable channel.

8. Landscaping and Irrigation Design for the HARP Phase I1I4-1 Project
The final design of the landscaping within the project limits as described by Exhibit A.
The final design of Irrigation systems with the project limits as described by Exhibit A, but
with consideration for the entire Phase III project.
9. Sidewalk, Site Furnishings, Lighting and Fountain Design for the Phase III4-1
Project
The final design of the pedestrian sidewalk system, site furnishings, site lighting and the
Basin fountain within the project limits as described by Exhibit A. This does not include the
relocation of the Wet Design Fountain at this time. The Wet Design Fountain relocation will
need to be a modification to the Agreement based on the results of the Aqua Engineering
investigation that is part of this phase and further direction from the City of Pueblo and
HARP.
10. Consultation with the Pueblo Board of Water Works regarding Water Line
Relocation Requirements
Consultant shall meet with a representative of the Pueblo Board of Water Works for the
purpose of obtaining a decision regarding the relocation or abandonment of a water line that
is presently on an alignment that intersects the HARP Phase IIIA -1 navigable channel. In
the event that the Pueblo Board of Waterworks decides to relocate the existing water line to
a location underneath the navigable channel, the consultant design contract will be
modified /amended to include the design of the relocated waterline underneath the navigable
channel.
11. Water Line Relocation under the HARP Phase I1I4-1 Channel (Potential addition
to the Scope ofServices for the HARP Phase ILI4-1 Project)
The final design of a relocation of the existing waterline that is presently located in Mechanic
Street at a location that will intersect the Phase III navigable channel is not a part of this
design contract and will need to be added, if required, as an amendment to this agreement.
The water line relocation design will be compliant with design standards of the Pueblo Board
of Water Works if authorized.
12. Storm water Quality Improvement Design for the HARP Phase III -A Project
Preparation of a Stormwater Management Plan for submittal to the City of Pueblo
Stormwater Utility

• Preparation of a Plan that shall be included in Construction documents that sets
forth all requirements for temporary erosion control during construction
• The final design of an oil and grease separator for the manhole that receives
stormwater from the existing inlets at the intersection of Richmond and Mechanic.
• The final design of a stormwater quality detention basin within the project limits of
the HARP Phase IIIA -1 project as described by Exhibit A. The Water Quality
Capture Volume for the Stormwater Quality Basin will be based in part on the
available space for water quality detention with the project limits. The final design of
the stormwater quality detention basin will include a slow release outlet system that
discharges to the storm sewer system while promoting infiltration through a long
detention time.
13. Pedestrian Bridge Abutments
• Consultant shall design the foundations for the planned pedestrian bridge over the
navigable channel.
14. Retaining Walls Adjacent to Grand Avenue Bridge
Consultant shall design retaining walls as necessary adjacent to the Grand Avenue
Bridge to provide for a detached sidewalk with a planting zone between the curb
and the sidewalk on Grand Avenue. The retaining walls shall include storage
chambers with access doors. The storage chambers will be located on both sides of
the navigable channel.
15 Construction Drawin , Requrremems
Consultant shall provide construction drawings Using AutoCAD using a 22'x 34" sheet size.
Lettering shall be of a size and weight to allow for reduction one -half size.
Construction drawings shall include the following drawings at a minimum:
• Cover sheet, which shall include project title showing participating agency names,
signatures for approval, location map and sheet index.
• Construction notes, pay limits and legends
• Structural details showing reinforcing steel and all embedded elements.
• Typical navigable channel cross sections
• Utility relocation details (does not include design and detailed plans for relocation of
electric, gas, cable television and telephone utilities)
• Standard details for manholes, inlets, curb and gutter and sidewalk
• Plan and profiles sheets showing area topography and horizontal alignment of site
features and utilities
• Plan and profiles for all sidewalks with the HARP Phase III -A project limits. Plan
and profile drawings shall indicate longitudinal slopes and cross slopes for pedestrian
walkways. All pedestrian sidewalks with the project limits of the HARP Phase III -A

project shall be compliant with the requirements of Americans with Disabilities Act
(ADA).
• Landscaping plans and details
• Irrigation plans and details
• Lighting plans with conduit runs and sleeving locations
16. Technical Speci& cation Requirements
Consultant shall prepare technical specifications on 8 -1 /2" by 11" paper. The technical
specifications shall follow the Construction Specifications Institute (CSI) format and shall
include the following (but not be limited to):
• Title Sheet
• Approval Signature with the same approval signature lines that are shown on the
construction drawings.
• Bid, Invitation for Bids, Instructions to bidders (Provided by Client)
• Bid Schedule
• Bonds and Contracts forms (Provided by Client)
• General Contract Conditions
• Measurement and Payment Section for all bid items
• Soils report
• Technical Specifications in CSI format (Following are the anticipated technical
specification sections required for the HARP Phase III -A Project)

17 Opinion ofProbable Construction Cost
Consultant shall prepare an opinion of probable construction cost for the HARP Phase
IIIA -1 project as described by the construction drawings and the technical specifications.
The opinion of probable construction cost shall be based on the extension of unit prices and
quantities determined by the consultant. Opinions of cost prepared by the Consultant
represent Consultants best judgment as a design professional and are supplied for general
guidance to the client. It shall be understood that Consultant has not control over cost of
labor or material, or over competitive bidding or marketing conditions. Consultant does not
guarantee that the low bidder shall provide a project cost that is at or below the opinion of
probable construction cost provided by the Consultant.
18. Design Report
Consultant shall provide a design report presenting the following information: Hydrologic
analysis; Hydraulic analysis; Structural analysis and other pertinent information developed
during the course of the design. Design report shall be bound and included among the
deliverables for the Final Plan Review Meeting.
19. Project Meetings
Consultant shall attend four meetings in Pueblo during the final design phase of the HARP
Phase IIIA -1 project. The final design phase of the project shall be the time period from the
beginning of the design phase completion of approved contract documents for the
construction of the HARP Phase IIIA -1 project.

20. Plan Approval
Consultant shall submit 70 % Submittal Package and Final Submittal Package with inclusions
as set forth in the Deliverables Section of this Scope of Services to the following designated
review entities for the HARP Phase IIIA -I project. Consultant shall submit bid tabulation
subsequent to bid opening to the HARP Authority.
