Munoz PuebloCtyClk &Rec RES R 6.00 D 0.00 RESOLUTION NO. 10687 A RESOLUTION TRANSFERRING TWO (2) CITY OWNED PARCELS OF LAND TO RIDGEGATE, LLC, A COLORADO LIMITED LIABILITY COMPANY FOR RIGHT -OF -WAY AND PARK LAND FOR THE INCLUSION AND DEDICATION OF SAID RIGHT -OF -WAY AND PARKLAND ON THE FUTURE PLAT OF EAGLERIDGE ESTATES, FILING NO. 2. WHEREAS, the City of Pueblo, a Municipal Corporation, the owner of real property within the Eagleridge Master Plan, Amended; and WHEREAS, the said land is being transferred to RIDGEGATE, LLC, a Colorado Limited Liability Company to be included and dedicated on the future plat of Eagleridge Estates, Filing No. 2 in order for the City of Pueblo to receive the desired right -of -way for Outlook and Eagleridge Boulevard and the desired parkland dedication; and BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Quit Claim Deeds from the City of Pueblo, a Municipal Corporation (Grantor) to RIDGEGATE, LLC a Colorado Limited Liability Company, copies of which are attached hereto, having been approved as to form by the City Attorney, are hereby approved and the President, of City Council is authorized to execute and deliver the Quit Claim Deeds in the name of the City. SECTION 2. The City Clerk is directed to cause said Quit Claim Deeds to be recorded immediately prior to the recording of the plat of Eagleridge Estates, Filing No. 2 in the office of the Pueblo County Clerk and Recorder. ISSUE Should the City Council transfer two (2) city owned parcels of land to RIDGEGATE, LLC, a Colorado Limited Liability Company for the dedication of right -of -way for Outlook and Eagleridge Boulevard and the dedication of parkland on the future plat of Eagleridge Estates, Filing No. 2. RECOMMENDATION Approval of this Resolution BACKGROUND RIDGEGATE, LLC, a Colorado Limited Liability Company is in the process of platting Eagleridge Estates, Filing No. 2 which is immediately adjacent to and nearly surrounding the city owned parcels. The city owned parcels for the parkland were previously deeded to the City of Pueblo from LT Properties for their park requirement within the Eagleridge Master Plan, Amended which was approved by the Planning and Zoning Commission and is currently on file. It was determined at that point in time that when this portion of the master plan would come before the subdivision process the City would deed the said parkland to the subdivider who would then subsequently dedicate the parkland on the subdivision plat. The other city owned parcel would be dedicated on the subdivision plat exclusively for the right -of -way of Outlook and Eagleridge Boulevard. (See attached exhibits for details) FINANCIAL IMPACT There is no financial impact to the City of Pueblo due to this action.
