RESOLUTION NO. 10686
A RESOLUTION ACCEPTING THE CONVEYANCE OF LAND BY
SPECIAL WARRANTY DEED FROM WL ENTERPRISES, LTD, A
NEW MEXICO LIMITED PARTNERSHIP AND APPROVING THE
SUBSEQUENT TRANSFER OF SAID DEEDED PARCEL TO
RIDGEGATE, LLC, A COLORADO LIMITED LIABILITY
COMPANY FOR THE INCLUSION IN THE FUTURE PLAT OF
EAGLERIDGE ESTATES, FILING NO. 2.
WHEREAS, WL Enterprise, Ltd., a New Mexico Limited Partnership, has executed and
delivered a deed to the City of Pueblo for a 2.02 acre parcel of land; and
WHEREAS, the said land will be transferred to RIDGEGATE, LLC, a Colorado Limited
Liability Company to be included and dedicated on the future plat of Eagleridge Estates, Filing
No. 2 in order for the City of Pueblo to receive the desired right -of -way for Wills Boulevard as
well as eliminate the remaining unusable land remnants, and
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The deed from WL Enterprise, Ltd. a New Mexico Limited Partnership (Grantor) to the
City of Pueblo, a Municipal Corporation (Grantee), a copy of which is attached hereto, having
been approved as to form by the City Attorney, is hereby approved and accepted.
SECTION 2.
The deed from the City of Pueblo, a Municipal Corporation (Grantor) to RIDGEGATE,
LLC, a Colorado Limited Liability Company (Grantee), a copy of which is attached hereto,
having been approved as to form by the City Attorney, is hereby approved and the President, of
City Council is authorized to execute and deliver the Quit Claim Deed in the name of the City.
SECTION 3.
The City Clerk is directed to cause said deeds to be recorded immediately prior to the
recording of the plat of Eagleridge Estates, Filing No. 2 in the office of the Pueblo County Clerk
and Recorder.

ISSUE
Should the City Council accept a deed from WL Enterprises, Ltd., a New Mexico Limited
Partnership, and approve the transfer to RIDGEGATE, LLC, a Colorado Limited Liability
Company, for right -of -way.
RECOMMENDATION
Approval of this Resolution
BACKGROUND
WL Enterprises, Ltd., a New Mexico Limited Partnership wishes to convey to the City of Pueblo a
parcel of land that will be then deeded to RIDGEGATE, LLC, a Colorado Limited Liability
Company. The majority of this parcel will be dedicated as a public road on the plat of Eagleridge
Estates, Filing No. 2. The City of Pueblo is requesting that said parcel be included within this plat.
This deed also includes small unusable remnants of land outside of the uniform proposed road right -
of -way, which will be absorbed, into the lots of this subdivision. This land transfer will enable the
City of Pueblo to receive the desired road right of way as well as eliminate any unusable parcel
remnants.

FINANCIAL IMPACT
There is no financial impact to the City of Pueblo due to this action.

SPECIAL WARRANTY DEED
THIS DEED, Made this,Hay of Fhru x 2006, between WL
ENTERPRISES, LTD, a New Mexico limited partnerkhip, grantor, and the CITY OF
PUEBLO, a Municipal Corporation, whose legal address is 1 City Hall Place, Pueblo,
Colorado 81003, of the County of Pueblo and State of Colorado, grantee:
WITNESSETH, That the grantor, for and in consideration of the sum of One
Dollar and other good and valuable consideration, the receipt and sufficiency of which is
hereby acknowledged, has granted, bargained, sold and conveyed, and by these
presents does hereby convey to the grantee herein named the real property, together
with improvements, if any, situate, lying and being in the County of Pueblo and State of
Colorado, described as follows:
SEE ATTACHED EXHIBIT A
TOGETHER with all and singular the hereditaments and appurtenances thereunto
belonging, or in any wise appertaining, and the reversion and reversions, remainder and
remainders, rents, issues, and profits thereof, and all the estate, right, interest, claim
and demand whatsoever of the grantor, either in law or equity, of, in and to the above
bargained premises, with the hereditaments and appurtenances.
TO HAVE AND TO HOLD the said premises above bargained and described, with the
appurtenances unto the grantee, its successors and assigns forever. And the grantor,
for itself, its successors and assigns, represents that at the time of the ensealing and
delivery of these presents it is well seized of the premises above conveyed, has good
and marketable title, and has good right, full power and lawful authority to grant,
bargain, sell and convey the same in manner and form as aforesaid.
The grantor warrants title against all persons claiming to hold title by, through or under
the grantor, subject to easements, reservations and covenants of record and taxes for
2006 and subsequent years.

City of Pueblo, a Municipal Corporation grantor, and
RIDGEGATE AT PUEBLO, LLC, a Colorado Limited Liability Company
whose legal address is 1700 Fortino Boulevard, Pueblo, CO 81008
of the County of Pueblo, and State of Colorado, grantee,
WITNESSETH, That the grantor for and in consideration of the sum of One Dollar and other good and
valuable consideration the receipt and sufficiency of which is hereby acknowledged, has remised, sold,
