A RESOLUTION AUTHORIZING THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, TO
ENTER INTO AN INTERGOVERNMENTAL USE AGREEMENT FOR THE PURPOSE OF
UTILIZING THE CITY OF PUEBLO'S FIRE DEPARTMENT FACILITIES AND EQUIPMENT FOR
CLASS INSTRUCTION IN FIRE SCIENCE CURRICULUMS
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Intergovernmental Use Agreement between Pikes Peak Community College and the
City of Pueblo, to allow the use of the Pueblo Fire Department's facilities and equipment for the
purpose of class instruction in Fire Science Curriculum, a copy of which is attached hereto, is
hereby approved.
SECTION 2.
This resolution shall become effective upon final approval.

FIRE DEPARTMENT FACILITIES AND EQUIPMENT FOR CLASS
INSTRUCTION IN FIRE SCIENCE CURRICULUM.
ISSUE
Should the City of Pueblo enter into an Intergovernmental Use Agreement with
Pikes Peak Community College?
RECOMMENDATION
Approval of Resolution.
BACKGROUND
The Fire Department wishes to enter into an agreement with Pikes Peak
Community College to utilize the City of Pueblo's Fire Department facilities,
equipment and classroom for the purpose of instructing Fire Science Classes.
FINANCIAL IMPACT
Due to the increased participation in Fire Science classes there will be a related
increase in tuition reimbursement per Union Contract.
INTERGOVERNMENTAL USE AGREEMENT

And
City of Pueblo
THIS USE AGREEMENT made the 11` day of January 2006 by and between the
State of Colorado, Department of Higher Education, State Board of Community Colleges
and Occupational Education, for the use and benefit of Pikes Peak Community College
located at 5675 S. Academy Blvd., Colorado Spring, CO 80906, hereinafter referred to as
the "State" and the City of Pueblo, a Municipal Corporation, located at 1 City Hall Place,
Pueblo, CO 81003, hereinafter referred to as the "City ".
RECITALS
A. City has a room at Pueblo Fire Department, Station 1, 425 W. 7 St., Pueblo,
Colorado, with adequate size and configuration available for PPCC to conduct
educational classes.
B. State Operates an educational facility and is in need of classroom space in
Pueblo to conduct this class.
C. City and State desire to enter into this Agreement to allow use of room to
conduct education classes.
AGREEMENT
In consideration of the needs of the City and State, the promises of both parties contained
herein, and other good and valuable consideration, the sufficiency of which is hereby
acknowledged by the parties, the parties agree as follows:
City agrees to provide to State classroom space on an as needed basis to
conduct educational classes, at no cost to PPCC.
II. Term of this agreement will be from January 16, 2006 through December 31,
2011. A thirty (30) day notice of termination must be given by either party
prior to end of the term of this agreement.
III. The State shall indemnify, defend and hold harmless the City against claims
arising from the alleged negligent acts or omissions of the State and its public
employees, which occurred or is alleged to have occurred during the
performance of their duties and within the scope of their employment, unless
such acts or omissions are, or are alleged to be, willful and wanton. Such
claims shall be subject to the limitations of the Colorado Governmental
Immunity Act, CRS 24 -10 -101 et.seg. as now or hereafter amended.
IV. All other specific details will be mutually agreed upon.
V The City warrants that it possesses the legal authority to enter into this
contract and that it has taken all action required by its procedures, by -laws,
and/or applicable law to exercise that authority, and to lawfully authorize its
undersigned signatory to execute this contract and to bind the City to its terms.
The person(s) executing this contract on behalf of the City warrant(s) that
such person(s) have full authorization to execute this contract.

CRS —24 -30 -202 requires that the State Controller approve all state contracts. This
contract is not valid until the State Controller, or such assistant as he may delegate, has
signed it. The contractor is not authorized to begin performance until the contract is
signed and dated below. If performance begins prior to the date below, the State of
Colorado may not be obligated to pay for the goods . and/or services provided.
