A RESOLUTION AUTHORIZING THE CITY OF PUEBLO TO APPLY FOR A 2006 EDWARD
BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) AND APPROVING A
MEMORANDUM OF UNDERSTANDING CONCERNING RECEIPT AND DISBURSEMENT OF
FUNDS FROM SAID GRANT
WHEREAS, the City of Pueblo Police Department is requesting that the City of Pueblo
submit an application to the United States Department of Justice (DOJ) for the 2006 Edward Byrne
Memorial Justice Assistance Grant (JAG); and
WHEREAS, the funds from this grant will be utilized by the Police Department, Sheriff's
Department, and the District Attorney's Office to benefit the health, welfare and safety of the
citizens of the City; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The grant application, a copy of which is attached hereto is hereby approved and
authorized for submittal to the United States Department of Justice.
SECTION 2.
The Memorandum of Understanding by and between the City of Pueblo, a Municipal
Corporation and Pueblo County, Colorado concerning the receipt and disbursement of the JAG
funds is hereby approved.

ISSUE
The United States Department of Justice (DOJ) has informed the Police
Department that funds are available under the Edward Byrne Memorial Justice
Assistance Grant (JAG). These funds are to be divided between the City and
County to their mutual satisfaction as per the attached Memorandum of
Understanding.
The department recommends approval of this resolution.
The Edward Byrne Memorial Justice Assistance Grant (JAG) Program provides
funds to units of local government for the purpose of improving law enforcement
technology and upgrading necessary equipment. The program is designed to
help local communities address problems specific to their area.
FINANCIAL IMPACT
None. There is no local match required.

Edward Byrne Memorial Justice Assistance Grant (JAG) for FY 2006
Program Narrative
The City of Pueblo, through its Police Department, would like to utilize the funds from
this grant to further the implementation of the wireless network to access Colorado Crime
Information and National Crime Information via mobile data terminals. We would also like to
purchase and upgrade technology and equipment designed to enhance security and surveillance
measures. Additionally, we would like to purchase law enforcement equipment that will
augment our community policing efforts.
The City of Pueblo, through its Police Department, has maintained a long- standing
mutual coordination with the Pueblo County Sheriff's Office and the Pueblo County District
Attorney's Office in regards to law enforcement programs and services. This mutual assistance
and coordination has been exemplified by our joint involvement in DARE Programs, Emergency
Management Systems, and public service events. We anticipate continued coordination and
cooperation among these agencies.
As a certified disparate jurisdiction submitting a joint application, the City of Pueblo will
receive $65,925.00, or 76% of the total award amount of $86,743.00. The City will use these
funds to purchase equipment for law enforcement projects and programs. The County will
receive $20,818.00 of which the Pueblo County Sheriffs Department will receive $16,655.00 to
purchase equipment for law enforcement. The Pueblo County District Attorney will receive
$4,163.00 of the County's allocation to purchase law enforcement equipment.

Budget Narrative
The City of Pueblo and Pueblo County are a certified disparate jurisdiction. Per the
Memorandum of Understanding that has been established between the City of Pueblo, Pueblo
County Sheriff s Department and Pueblo County District Attorney's Office, the City of Pueblo
will receive $65,925.00, or 76% of the total award amount of $86,743.00. The City will use
these funds to purchase equipment for law enforcement projects and programs. The County will
receive $20,818.00 of which the Pueblo County Sheriffs Department will receive $16,655.00 to
purchase equipment for law enforcement. The Pueblo County District Attorney will receive
$4,163.00 of the County's allocation to purchase law enforcement equipment.
Since the length of the award is for a total of 4 years, it is anticipated that the City of
Pueblo would spend approximately 25% of the total award, or $16,481.00, each year for the next
4 years. The expended funds would be used to purchase and upgrade technology and equipment
as required, fulfilling our law enforcement and community policing mission.

Review Narrative
The City of Pueblo is governed by a seven - member City Council and the City is managed
by the City Manager, Mr. David J. Galli, who is appointed by the City Council. The grant
application was completed online on or about January 13, 2006. The grant application was made
available for review to the members of City Council and the City Manager on or about January
23, 2006. It is anticipated that the grant application will be submitted on or about March 01,
2006. Thus the grant application was made available for review to the governing body of the
City of Pueblo more than 30 days before the application was submitted to the Bureau of Justice
Assistance.
Additionally, on or about the first week of February 2006, a public meeting concerning
this grant application was advertised in the local newspaper, The Pueblo Chieftain. Citizens and
neighborhood or community organizations were invited to participate in the public meeting and
offer comments in regards to the stated purposes of the grant funds. On or about the first week
of February 2006, this public meeting was conducted at the Pueblo Police Department's
facilities.
MEMORANDUM OF UNDERSTANDING
CONCERNING RECEIPT AND DISBURSEMENT OF
EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG)
FUNDS FOR FY 2006
THIS MEMORANDUM OF UNDERSTANDING is made and entered into
this 23`d day of January 2006, by and between the City of Pueblo, a Municipal
Corporation (hereafter referred to as the "City ") and Pueblo County, Colorado
(hereafter referred to as the "County").
WITNESSETH:
WHEREAS, the parties recognize that for FY 2006 Edward Byrne Memorial
Justice Assistance Grant (JAG) funding, administered by the U.S. Office of Justice
Programs, Pueblo County has been certified as a disparate jurisdiction by the
Colorado State Attorney General's Office; and
WHEREAS, Federal Edward Byrne Memorial Justice Assistance Grant
funding requires that a certified disparate county and the city or cities within the
county are to divide available funds to their mutual satisfaction, and that if the
parties are unable to reach a mutual agreement, no jurisdiction is eligible to receive
funds; and
WHEREAS, the parties reached an agreement over the receipt of
$86,743.00 in JAG funds and the disbursement of those funds and wish to set
such agreement as follows.
NOW, THEREFORE, in consideration of the mutual covenants contained
herein and in accordance with Federal law, the parties agree as follows:
1. The $86,743.00 JAG Grant Funds will be allocated as follows: The
City will receive $65,925.00 to purchase equipment for law enforcement. The
County will receive $20,818.00 of which the Pueblo County Sheriffs Department
will receive $16,655.00 to purchase equipment for law enforcement. The Pueblo
County District Attorney will receive $4,163.00 of the County's allocation to
purchase equipment for law enforcement. The City will serve as the applicant/fiscal
agent.
2. The City, County, Pueblo County Sheriff's Department and Pueblo
County District Attorney shall meet and comply with the general and special
conditions set forth in the FY 2006 JAG Grant Funds Award.
