HomeMy WebLinkAbout10611RESOLUTION NO. 10611 A RESOLUTION APPROVING A MEMORANDUM OF AGREEMENT BETWEEN PUEBLO COMMUNITY COLLEGE AND THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, FOR THE USE OF THE PUEBLO MEMORIAL AIRPORT BLITZ HANGAR FOR AVIATION EDUCATIONAL PURPOSES WHEREAS, the City of Pueblo enjoys a strong community bond with Pueblo Community College and other higher education institutions; and WHEREAS, the City of Pueblo supports Pueblo Community College in its efforts to offer educational programs that will enhance opportunities for current students and citizens of the Southern Colorado region; and WHEREAS, the City of Pueblo would like to cooperate and contribute resources toward Pueblo Community College and its efforts in developing a well educated and trained workforce; and WHEREAS, City Council acknowledges the importance of contributing and cooperating with Pueblo Community College and its efforts of higher education excellence. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: City Council hereby approves the attached Memorandum of Agreement and President of City Council is authorized to sign said agreement in the name of the City. BACKGROUND Pueblo Community College (PCC) has requested assistance from the City regarding classroom space for its Aviation Program. PCC is offering program courses in upholstery work as it pertains to aircraft and airline equipment. At this time, PCC will only use the Blitz Hangar for upholstery programs and will need approval from the City if they want to expand their aviation activities. It has been requested by PCC and is the recommendation of the City Administration that the Blitz Hangar be available for use beginning in late January for the spring 2006 semester. This Memorandum of Agreement will retroactively become effective December 15, 2005. RECOMMENDATION Approval of the Resolution. FINANCIAL IMPACT None. Memorandum of Agreement Between The City of Pueblo and Pueblo Community College This Memorandum of Agreement (MOA) is in support of the effort of the City of Pueblo and Pueblo Community College, hereafter PCC, for PCC to use the Blitz Hangar located at the Pueblo Memorial Airport 31201 Bryan Circle Pueblo, CO 81001, effective December 15, 2005. Responsibilities of City of Pueblo in support of this MOA: • Provide initial clean-up of the hangar area of the Blitz Hangar; • Provide fire and extended coverage insurance for the Blitz Hangar; • Provide liability insurance for the property; • Recharge the fire suppression system; • Provide maintenance, but not replacement or major repairs, to the heating, plumbing, and electrical systems and hangar doors. • Provide security and parking at locations designated by City. Responsibilities of PCC in support of this MOA include: • PCC will use and occupy the Blitz Hangar at no cost to PCC other than those listed herein; • PCC will conduct aviation related courses and fundraising activities including, but not limited to aircraft maintenance and refurbishing; • PCC is responsible for the coordination and installation of phones and computers within the Blitz Hangar; • PCC is responsible for costs related to minor renovations needed to enlarge the conference room area; • PCC will provide tables, desks and all other equipment or furnishings necessary for instruction; • PCC will be allowed to invoice for related supplies and services such as, but not limited to upholstery, aircraft maintenance and refurbishing. This will include entering into agreements with individuals or groups of individuals for the purpose of generating funds for program development and continuation; • PCC will be able to access the Blitz Hangar for set -up no later than December 15, 2005, with spring classes starting January 9, 2006; • PCC will provide initial clean-up and minor repairs to classrooms, walls and offices located in the Blitz Hangar; • PCC will be responsible for payment of all utilities in the Blitz Hangar; • PCC will provide custodial services and trash removal; PCC will provide liability insurance and workers' compensation coverage for its employees and students. It is mutually understood that: 1. This MOA is effective December 15, 2005. 2. For administrative support purposes while on the Pueblo Memorial Airport premises, officials will direct questions regarding PCC aviation program activities to PCC Department Chair, Jim Torres at 549 -3249. 3. City will allow PCC access to and use of the Blitz Hangar for student instruction and PCC accepts the use of the Blitz Hangar upon the terms and conditions set forth in this MOA. 4. This MCA may be amended or renewed by mutual agreement of City and PCC. Either party may terminate this MOA upon thirty (30) days prior written notice specifying the date of termination, provided, that if this MCA is terminated during any PCC semester in which students are enrolled in classes using the Blitz Hangar, termination will not become effective until the end of such semester. 5. PCC shall not use the Blitz Hangar for other than upholstering programs without the prior written consent of City Manager, which may be withheld for any reason. Additional Provisions: • PCC acknowledges that City has made no representations or warranties with respect to the present condition of the Blitz Hangar, either environmentally or otherwise. Except as otherwise specifically provided herein, PCC accepts the Blitz Hangar in its present condition "AS IS" and "WITH ALL ITS FAULTS." • The Environmental Covenant attached hereto is incorporated herein in full and PCC agrees to abide by the restrictions therein set forth. PCC agrees that it will comply fully and promptly with any and all environmental laws, statutes, regulations, policies and orders issued by any federal or state governmental authority; that is will obtain, maintain in full force and effect and strictly comply with any and all governmental permits, approvals and authorizations necessary for the conduct of its business and activities in the Blitz Hangar; that it will supply City with copies of any such permits, approvals and authorizations; that it will promptly notify City and supply City with a copy of any notice of violation of any environmental law, statute, policies or order PCC receives; and that it will keep complete and accurate records of the purchase, use, storage, and disposal of all toxic and/or hazardous substances which are brought onto, or created on, or in the Blitz Hangar in accordance with all applicable federal and state laws and regulations and provide access to City to all such records.
