HomeMy WebLinkAbout10558RESOLUTION NO. 10558 A RESOLUTION APPROVING AMENDMENT NO. 1 FOR PHASE II TO THE AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN THE FIRM OF ROBERT ODLAND CONSULTING AND THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, RELATING TO THE PUEBLO CHARTER NEIGHBORHOODS REZONING PROJECT AND AUTHORIZING THE PRESIDENT OF COUNCIL TO EXECUTE SAME WHEREAS, resolution No. 9657, dated August 12, 2002 authorized the City of Pueblo to enter into a professional service agreement with Robert Odland Consulting for the completion of the Charter Neighborhoods Rezoning Project; and WHEREAS, completion of the Scope of Services for said project led to a recognition that more detailed research and public input were required than originally anticipated, necessitating a second phase to the project; and WHEREAS, Amendment No. 1 will approve Robert Odland Consulting to continue providing service, as outlined in the attached Scope of Services for Phase II of the project; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Amendment No. I to the Agreement for Professional Services, dated August 12, 2002, between the City of Pueblo, a Municipal Corporation, and Robert Odland Consulting, of which a copy is attached hereto and on file at the office of the City Clerk, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The President of the City Council is hereby authorized to execute and deliver said Amendment No. 1, in the name of and on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest same. SECTION 3. Funds for Phase II shall not exceed a total of $16,660 for said professional services and paid from Account No. 250 - 9540 - 600.8050, Project No. CD0147. RECOMMENDATION Approval of the Resolution BACKGROUND On August 12, 2002, City Council approved Resolution 9657, entering into an agreement with Robert Odland Consulting for a project reexamining the appropriateness of current zoning for Pueblo's Charter Neighborhoods (platted prior to 1900). Completion of the project Scope as written led to a proposal for a Conservation District Overlay Zone, accompanied by design guidelines for the preservation of traditional lifestyles in the charter neighborhoods. Considerable staff input has been generated, and several community stakeholder groups have been identified who wish to provide detailed input. Phase 11 of the project will coordinate and incorporate the perspectives of stakeholders and staff, revise the proposed ordinance and design guidelines accordingly, and prepare the proposal for adoption. Amendment No. I to the Professional Service Agreement dated August 12, 2002 will amend the original Agreement to allow Robert Odland Consulting to continue with providing services relating to Phase II, as envisioned in the original scope of the funded project, and described in Exhibit B. FINANCIAL IMPACT $55,000 in 2002 CDBG funds were originally allocated in CDO147 for completion of this project. The Phase I contract amount was $35,000, leaving $20,000 for additional work on a Phase II of the project. Funds shall be made available for Phase II of the project not to exceed $16,660 for professional services, from Account No.250- 9540-600.8050, Project No. CD0147. Amendment #1 for Phase 2 to Agreement for Professional Services Between the City of Pueblo and Robert Odland Consulting Dated August 1, 2002 (Resolution No. 9657) 1. Paragraph 1 is amended to read as follows: SCOPE OF SERVICES. Subject to the terms and conditions set forth in this Agreement, Consultant shall provide to the City the services described in Exhibit A and Exhibit B . Consultant shall provide the services at the time, place and in the manner specified in Exhibit A and Exhibit B . 2. Paragraph 2 is amended to read as follows: COMPENSATION. City hereby agrees to pay Consultant for the performance of all consulting services and costs incurred under this Agreement the maximum sum of [Thirty -Five Thousand Dollars ($35,000.00)] Fifty -One Thousand Six Hundred and Sixty Dollars ($ 51,660 . Consultant shall be paid within thirty (30) days of receipt of invoices containing all information set forth in paragraph 5 below. In no event shall Consultant be entitled to compensation for extra work unless a written order or authorization describing the extra work and payment terms has been executed by City prior to the commencement of work. 3. Paragraph 3 is amended to read as follows: EFFECTIVE DATE AND TERM. The term of this Agreement shall commence September 1, 2002 (the "effective date ") and terminate [July 1, 20031 hW 1. 2006 unless sooner terminated as herein provided. Consultant shall complete the Scope of Services on or before [September 1, 20031 May 1, 2006 4. Paragraph 16 is amended to read as follows: NOTICES. ScVlling, Jr President, City Council ' 2 EXHOIT B — PHASE II SCOPE OF SERVICES Scope of Services for Project No.: 01 -100, Land Use Regulation Revision. The objective of the project is to assist the Department of Community Development in revising or rewriting parts of the City's land use regulations that relate to the preservation of older neighborhoods and the creation of new livable communities in neighborhoods that are eligible for CDBG funding. Task 1.0 Review Current Draft of Ordinance and Guidelines 1.1 The Consultant will review the current draft of the Conservation District Overlay Zone Ordinance and any comments from staff or other local reviewers. 1.2 The Consultant will review the current draft of the Neighborhood Conservation & Neighborhood Commercial Design Guidelines and any comments from staff or other local reviewers to determine consistency with the ordinance and to analyze the need for any other changes. 1.3 The Consultant will prepare a memorandum that contains the results of the reviews performed in Task 1.1 and 1.2. Task 2.0 Facilitate Charrette(s) 2.1 The Consultant will facilitate a charrette to present the proposed ordinance and design guidelines, together with recommended changes, to City staff, other officials, residents, and other identified parties. Consultant will facilitate a second charrette for a similar group provided both charrettes are on the same or subsequent days. 2.2 The Consultant will meet with City staff immediately after the conclusion of the charrette(s) to review results and discuss next steps. Task 3.0 Revise Ordinance 3.1 The Consultant, working closely with City staff including the City Attorney, will revise the Conservation District Overlay Zone Ordinance based on the results of Task 2.0. The Consultant will then submit the revised ordinance to City staff. 3.2 The Consultant will make minor changes to the ordinance, not to exceed four hours of work, in response to final comments by City staff. Task 4.0 Revise Design Guidelines 4.1 The Consultant, working closely with City staff including the City Attorney, will revise the Neighborhood Conservation & Neighborhood Commercial Design Guidelines based on the results of Task 2.0. The Consultant will then submit the revised ordinance to City staff. 4.2 The Consultant will make minor changes to the design guidelines, not to exceed four hours of work for text revisions and eight hours of work for graphics revisions, in response to final comments by City staff. Task 5.0 Present Ordinance and Guidelines 5.1 The Consultant will present the proposed ordinance and design guidelines to the Planning Commission or a joint meeting of the Planning Commission and the City Council. Responsibilities Consultant: • Prepare materials for meetings • Submit a camera -ready copy of all work products • Submit an electronic version of all final work products • Submit monthly invoices based on work completed on each task City of Pueblo: • Provide existing plans, maps, and other information to the Consultant • Notify Consultant of relevant local events during the course of the project • Schedule and send notices, as required, for all meetings • Arrange for meeting rooms Schedule The project is expected to take six months to complete.
