RECOMMENDATION Approve the Resolution. BACKGROUND The Governor and the Colorado Department of Local Affairs (DOLA), working cooperatively with the Colorado State Patrol (CSP) and the Colorado Division of Information Technology (DOIT) are making available grant funds to improve the local and state communications network in the 800 mhz band. The grant funds can be used for digital trunk radio infrastructure, digital trunked radio towers and site equipment. These funds are being set aside from DOLA's regular allocations of state Energy and Mineral Impact Assistance Fund (Impact) and are being made available on a one - time -only basis through a special funding cycle. The City is requesting funds to construct four microwave towers and associated site equipment to serve the City. FINANCIAL IMPACT The City is requesting $1,965,700 million from DOLA for the project. The City will be required to provide as an in -kind contribution the land, access road and power for each site. The City may need to acquire one or more of these sites. Brief Description of Proposed Project (+oo words or less): The City of Pueblo is requestina $1.965.700 million dollars to construct five digital trunked radio towers and provide associated site equipment. The five sites include one in each of the City's four quadrants and one site centrally located in downtown. Funding this program will facilitate the City's 800 mhz network conversion and allow interoperability between the City's Police and Fire Department, Pueblo County and state and federal public safety agencies. The selection of the sites and the conversion is being undertaken in collaboration with a similar effort in Pueblo County. 7. a. RELATIONSHIP TO ENERGY/MINERAL IMPACT. Assistance program is to provide financial assistance to to provide an opportunity for the applicant to relationship of application to those impacts. Facilitates communication between public safety entities which may lessen the impact of a natural or man made disaster as it may effect the traffic of coal trains through Pueblo County or the generation of electricity from Xcel's Comanche generating facility. 2. a. What direct energy /mineral impacts are being experienced by the applicant? Examples of direct impacts include: road /bridge /culvert damage, fire protection/emergency medical services, dust suppression, soundtvisual mitigation, weed control, economic boom/busts and other direct physical, social or economic impacts. The Xcel expansion will require the need to improve existing roadways to handle increased construction traffic within existing Salt Creek and Blende/St. Charles Mesa neighborhoods. Assistance will be provided to address this and other infrastructure issues including drainage impacts resulting from roadway improvements that may impact the region. The 2000 census confirms that the growth in the Pueblo Region is the lowest of the fifteen most populated counties in Colorado reflecting the continuing impacts of the energy bust of the 1980's and consolidation within the railroad industry. b. What types and amounts of local funds and resources are being used by the applicant to address direct energy /mineral impacts? Examples of funds and resources include: road and bridge funds, Highway User Trust Fund allocations, industry assessments or contributions, sales or property taxes, staff time, etc. Page 3 of 6 Pages Pueblo has a 0.5 -cent sales tax which is used to attract primary jobs, and we use numerous funding sources to create affordable housing and community amenities. 3. List energy /mineral activities (past, present and future) affecting the applicant. Be as specific as possible by listing company names, locations, production levels, employment levels, etc. Include not only production projects (e.g., oil, gas, carbon dioxide, coal, molybdenum, gold, etc.), but also processing, transmission (e.g., oil /gas pipelines, electric transmission lines, etc.), transportation (e.g., roads, rail lines, etc.) and energy conversion facilities (e.g., coal and gas -fired electric generating facilities). Subsequent to the strike of 1997, RMS is operating with a work force of approximately 300 less than at the pre-strike level. Although RMS has reopened the seamless tube mill, which is directly related to demand for seamless tube products for the oil industry, there remains considerable fluctuation in demand and employment. Abandonment of rail lines located ENV through Pueblo as a result of the UP /SP rail merger resulted in a loss of approximately 139 workers and Shipment of ENV coal through Pueblo. The expansion of Xcel's Comanche coal fired generating facility will result in an additional 1000 construction jobs over a 4 year period and an additional 30 to 40 permanent jobs created to operate the facility. Please see attached Related Employment. 4. Are energy /mineral companies that impact the applicant jurisdiction aware of and supportive of this request? Yes X No Attach supporting documentation when appropriate. The City of Pueblo works closely with Rocky Mountain Steel Mills and Xcel. E. OTHER PROJECT INFORMATION 1. Why is the project needed? What are the specific goals of the project? Currently the City's Police and Fire Departments communicate on different frequencies. All communication must be relayed through the dispatch center. The County's emergency management and public safety agencies and the State public safety organizations also communicate on different frequencies. This conversion will allow all these public safety entities to communicate directly. 2. How were the cost estimates arrived at? Have preliminary architectural /engineering studies been completed? What additional design work must still be completed? (Attach preliminary engineering reports, architectural drawings, cost estimates, detailed project budget.) Estimates were provided by vendors and the Department of Local Affairs. 3. a. Describe local commitment to the project, including local fees or regulations altered to ensure project success, local taxing efforts to address continuing development and maintenance needs, and local citizen support. Describe any in -kind contributions, by type and value, in support of this project. The City of Pueblo will provide the digital trunked radio tower sites, the access road, and will extend the electricity to each site. The City will also fund the ongoing operation and maintenance for each site. b. Was the cash value of the in -kind contributions calculated into the Project Budget (C)? Yes X No _ The value of the in -kind contribution was not estimated. Some of these sites the City presently owns others may need to be acquired. 4. What other funding alternatives have been explored? General Fund; Chemical Stockpile Emergency Preparedness Program funds, which require a 66% match; and Homeland Security Funds, for which we have applied and have been unsuccessful in receiving. 5. Has the applicant jurisdiction been subject to any refund under TABOR or statutory tax limitations? Has the applicant sought voter approval to keep revenues above fiscal spending limits ?Yes X No _ If yes, please explain. When required, the City has sought voter approval to keep revenues above fiscal annual spending limits. Only once has the City not received voter approval. In 2003 a broad based citizen initiative to remove the Page 4 of 6 Pages City from TABOR spending limits failed. 6. If the applicant jurisdiction is classified as an enterprise under TABOR, will acceptance of a state grant affect this status? Yes _ No X Please explain. The City will provide the ongoing maintenance and operation of the facilities. The City currently provides operation and maintenance for its existing facility and its not anticipated that the operation and maintenance cost for the new facilities will be significantly different. 8.
