DIIORIO WATER RECLAMATION FACILITY AND CANCELING THE PROJECT WHEREAS, Resolution 10438 approved the award of a contract to install dewatering wells and associated piping and metering at the James R. Dilorio Water Reclamation Facility to Spaccamonti Excavating, Inc. (the "Project') on July 11, 2005; and; WHEREAS, it has been determined that there does not exist a sufficient unencumbered balance of appropriations for the entire cost of this contract, and the City cannot lawfully proceed with the Project at this time; BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Resolution No. 10438 is hereby rescinded in its entirety, the Project is postponed indefinitely and no contract will be awarded at this time to undertake the Project; and SECTION 2. The Purchasing Agent is hereby authorized to notify Spaccamonti Excavating, Inc. that the Project is cancelled. INTRODUCED August 8, 2005 .. DIIORIO WATER RECLAMATION FACILITY AND CANCELING THE PROJECT. ISSUE Should the City Council rescind Resolution 10438 in its entirety? RECOMMENDATION Approve this Resolution. BACKGROUND The Wastewater Department included in its annual budget request for 2005 a capital project for installation of a dewatering system at the Water Reclamation Facility. The capital project included a funding request for $100,000 per year over a period of three consecutive years (2005, 2006 and 2007) to fund the well construction. The project was bid in 2005, and Resolution 10438 was passed on July 11, 2005 erroneously awarding the project to Spaccamonti Excavating, Inc. Because the unencumbered balance of appropriated funds is presently unable to meet the payment obligations under the contract, the contract may not be lawfully entered into, per § 7 -18(k) of the Charter, § 24- 91- 103.6, C.R.S. (2004), and Article X, § 20 of the Colorado Constitution. FINANCIAL IMPACT Because no funds will be expended at this time for this project, there is no financial impact.
