A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE WITH COLORADO REVISED
STATUTES SECTION 31 -12 -107 (1) OF THE PETITION FOR THE ANNEXATION OF THE AREA
COMMONLY KNOWN AS THE ROCKY MOUNTAIN STEEL ANNEXATION PHASE 4 AND
DESCRIBED AS WEST OF LIME ROAD AND SOUTHEAST OF THE INTERSTATE 25 AND
PUEBLO BOULEVARD INTERCHANGE
WHEREAS, a Petition For Annexation of the area described in Section 1 hereof has been
filed with the City Clerk, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
The Petition For Annexation of the following described area situated in Pueblo County,
Colorado, is hereby found and determined to be in substantial compliance with the provisions of
C.R.S. §31 -12 -107 (1):
Rocky Mountain Steel Phase 4
A parcel of land located within the Southwest one - quarter of Section 17, the Southeast one - quarter
of the Southeast one - quarter of the Southeast one - quarter of Section 18, and all of Section 19,
Township 21 South, Range 64 West of the 6th Principal Meridian, in the County of Pueblo, State of
Colorado, being more particularly described as follows:
Beginning at Northwest corner (found monument with a 3 Yd' aluminum cap, L.S. #33651) of
Section 20, Township 21 South, Range 64 West;
1. Thence N 83 37' 14" E a distance of 347.58 feet;
2. Thence S 39 23' 03" W a distance of 1,612.27 feet to the beginning of a tangent curve
to the right having a radius of 1,720.00 feet;
3. Thence along the arc to a curve to the right, through a central angle of 26 24' 11" a
distance of 792.61 feet whose chord bears S 52 35' 08" W a distance of 785.61 feet;
4. Thence S 65 47' 14" W a distance of 3,230.26 feet to the beginning of a tangent curve
to the right having a radius of 1,720.00 feet;
5. Thence along the arc to a curve to the right, through a central angle of 09 12' 46" a
distance of 276.56 feet whose chord bears S 70 23' 37" W a distance of 276.27 feet;
6. Thence S 75 00' 00" W a distance of 790.41 feet;
7. Thence N 15 00' 00" W a distance of 15.00 feet (Existing City Limits Line);
8. Thence N 75° 00' 00" E a distance of 790.41 feet to the beginning of a tangent curve to
the left having a radius of 1,690.00 feet (Existing City Limits Line);
9. Thence along the arc of a curve to the left, through a central angle of 09 12' 46" a
distance of 271.74 feet whose chord bears N 70 23' 37" E a distance of 271.45 feet
(Existing City Limits Line);
10. Thence N 65 47' 14" E a distance of 1,300.00 feet (Existing City Limits Line);
11. Thence N 24 12' 46" W a distance of 60.00 feet (Existing City Limits Line);
12. Thence S 65 47' 14" W a distance of 1,300.00 feet to the beginning of a tangent curve
to the right having a radius of 1,630.00 feet (Existing City Limits Line);
13. Thence along the arc of a curve to the right, through a central angle of 09 12' 46" a
distance of 262.09 feet whose chord bears S 70 23' 37" W a distance of 261.87 feet
(Existing City Limits Line);
14. Thence S 75 00' 00" W a distance of 790.41 feet (Existing City Limits Line);
15. Thence N 15° 00' 00" W a distance of 15.00 feet (Existing City Limits Line);
16. Thence N 75° 00' 00" E a distance of 790.41 feet to the beginning of a tangent curve to
the left having a radius of 1,600.00 feet;
17. Thence along the arc of a curve to the right, through a central angle of 09° 12' 46" a
distance of 257.27 feet whose chord bears N 70° 23' 37" E a distance of 261.87 feet;
18. Thence N 65 47' 14" E a distance of 3,230.26 feet to the beginning of a tangent curve
to the left having a radius of 1,600.00 feet;
19. Thence along the arc to a curve to the left, through a central angle of 26° 24' 11" a
distance of 737.31 feet whose chord bears N 52° 35' 08" E a distance of 730.08 feet;
20. Thence N 39 23' 03" E a distance of 1,755.36 feet;
21. Thence S 50° 36' 57" E a distance of 120.00 feet;
22. Thence S 83° 37' 14" E, to a point on the East line of said Section 18, a distance of
263.60 feet;
23. Thence S 89° 23' 07" E, along a line parallel with the North line of said Section 20, a
distance of 2,643.76 feet to a point on the West line of a 40.35 acre parcel of land as
described in that Alta /Acsm Land Title Survey as prepared by Abel Engineering
Professionals, Inc. on March 26, 2000 and filed with the County of Pueblo on April 26,
2000;
24. Thence S 00° 36' 53" W, along said West line of said 40.35 acre parcel, a distance of
120.00 feet to a point on said North line of Section 20;
25. Thence N 89° 23' 07" W, along said North line of Section 20, a distance of 2,649.80 feet
to the Point of Beginning.
Said Parcel contains 23.64 acres, more or less.
BASIS OF BEARINGS
Bearings are based on the North line of Section 20, Township 21 South, Range 64 West from the
Northwest corner (found monument with a 3 Yd' aluminum cap, L.S. #33651) to the Northeast
corner (found monument with a 3 Yd' aluminum cap, L.S. #33651) to bear
S 89 23'07" E.
SECTION 2.
A public hearing to determine if the area proposed to be annexed meets the applicable
requirements of C.R.S. §31 -12 -104 and C.R.S. §31 -12 -105 to establish eligibility for annexation
under the Municipal Annexation Act of 1965 shall be held before the City Council in Council
Chambers, Second Floor, City Hall, One City Hall Place, Pueblo, Colorado on Monday, September
12, 2005, commencing at 7:00 p.m. or as soon thereafter as City Council business allows. The
City Clerk shall publish notice of the public hearing once a week for four successive weeks in the
Pueblo Chieftain. The first publication of such notice shall be at least thirty (30) days prior to the
date of the hearing. A copy of the published notice, together with a copy of the Petition for
Annexation, shall be sent by registered mail by the City Clerk to the Board of County
Commissioners and the County Attorney of Pueblo County and to any school district or special
district having territory within the area to be annexed at least twenty five days prior to the date of
the hearing.

ISSUE
Shall the City Council approve and adopt findings and determination concerning
the proposed annexation?
RECOMMENDATION
A public hearing on the proposed Rocky Mountain Steel Annexation Phase 4 is
scheduled for the August 10, 2005 City of Pueblo Planning and Zoning
Commission. At that meeting the Planning and Zoning Commission could make
a recommendation on the proposed annexation, which will be forwarded to City
Council and be entered into the public record.
BACKGROUND
The Rocky Mountain Steel Annexation Phase 4 submitted by Rocky Mountain
Steel Mills comprises 23.64 acres located west of Lime Road and southeast of
the Interstate 25 and Pueblo Boulevard interchange. This annexation petition is
the fourth in a series of four phased annexations of property into the City of
Pueblo that comprise the flag pole extension of city boundaries which enable the
annexation of the Xcel Energy property into the City of Pueblo. This Resolution
determines that the Petition for Annexation is found and determined to be in
substantial compliance with the provisions of the Colorado Revised Statutes 31-
12- 107(1). A public hearing is scheduled for September 12, 2005 to determine if
the area proposed to be annexed meets the applicable requirements of C.R.S.
31 -12 -104 and 31 -12 -105 to establish eligibility for annexation under the
Municipal Annexation Act of 1965. It also directs the City Clerk to publish notice
of public hearing once a week for four successive weeks in the Pueblo Chieftain.
By approving the attached resolution City Council finds the annexation petition is
in substantial compliance with state annexation statutes and sets the date of
September 12, 2005 for a public hearing. The date for the first presentation of
the Ordinance for Annexation is scheduled for August 22, 2005.
FINANCIAL IMPACT
The filing of the annexation petition and this Finding of Substantial Compliance
does not result in any direct financial impact to the City of Pueblo.
