A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE WITH COLORADO REVISED
STATUTES SECTION 31 -12 -107 (1) OF THE PETITION FOR THE ANNEXATION OF THE AREA
COMMONLY KNOWN AS THE ROCKY MOUNTAIN STEEL ANNEXATION PHASE 1 AND
DESCRIBED AS WEST OF LIME ROAD AND SOUTHEAST OF THE INTERSTATE 25 AND
PUEBLO BOULEVARD INTERCHANGE
WHEREAS, a Petition For Annexation of the area described in Section 1 hereof has been
filed with the City Clerk, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
The Petition For Annexation of the following described area situated in Pueblo County,
Colorado, is hereby found and determined to be in substantial compliance with the provisions of
C.R.S. §31 -12 -107 (1):
Rocky Mountain Steel Phase 1
A parcel of land located within the East one -half of the Northeast one - quarter of Section 26,
Township 21 South, Range 65 West of the 6th Principal Meridian, in the County of Pueblo, State of
Colorado, being more particularly described as follows:
Beginning at a point on the Southeasterly line of Minnequa Industrial Park, Second Filing according
to the recorded plat thereof filed for record January 28, 2003 at Reception No. 1481756, Pueblo
County records from which the Northwest corner (found monument with a 3 Yd' aluminum cap, L.S.
#33651) of Section 20, Township 21 South, Range 64 West bears N 62 55' 29" E a distance of
13,036.25 feet;
1. Thence S 30 13' 01" E a distance of 756.60 feet to the beginning of a tangent curve to
the left having a radius of 960.00 feet;
2. Thence along the arc of a curve to the left, through a central angle of 57 40' 27" a
distance of 966.34 feet whose chord bears S 59 03' 14" E a distance of 926.06 feet;
3. Thence S 87 53' 28" E a distance of 593.28 feet to the beginning of a tangent curve to
the left having a radius of 1,290.00 feet;
4. Thence along the arc of a curve to the left, through a central angle of 71 11' 13" a
distance of 1,602.76 feet whose chord bears N 56 30' 55" E a distance of 1,501.64
feet;
5. Thence N 20 55' 19" E a distance of 1,950.02 feet to the beginning of a tangent curve
to the right having a radius of 1,720.00 feet;
6. Thence along the arc of a curve to the right, through a central angle of 24 22' 41" a
distance of 731.82 feet whose chord bears N 33 06' 39" E a distance of 726.32 feet;
7. Thence N 35 05' 24" W a distance of 65.89 feet to the beginning of a non - tangent
curve to the right having a radius of 1,785.00 feet;

distance of 846.66 feet whose chord bears N 59 14' 29" E a distance of 838.74 feet to
a point on the Westerly Right of Way line of the Burlington Northern Santa Fe & Union
Pacific Railroad;
9. Thence S 02° 27' 37" W, along said Westerly Right of Way line, a distance of 268.24
feet to the beginning of a non - tangent curve to the left having a radius of 1,535.00 feet;

point on the North line of a property exhibit prepared by Cardinal Land Surveying, Inc.

17. Thence N 89° 13' 11" W along said North line a distance of 84.86 feet to the beginning
of a non - tangent curve to the right having a radius of 960.00 feet;
18. Thence along the arc of a curve to the left, through a central angle of 03 49' 56" a
distance of 64.21 feet whose chord bears N 21' 26' 23" W a distance of 64.20 feet;
19. Thence N 23° 21' 21" W a distance of 372.03 feet to the beginning of a non - tangent
curve to the left having a radius of 1,410.00 feet;
20. Thence along the arc of a curve to the right, through a central angle of 23 50' 21" a
distance of 586.66 feet whose chord bears S 80° 11' 21" W a distance of 582.44 feet;
21. Thence N 87° 53' 28" W a distance of 857.41 feet to the beginning of a tangent curve to
the left having a radius of 200.00 feet;
22. Thence along the arc of a curve to the left, through a central angle of 97 26' 18" a
distance of 340.12 feet whose chord bears S 43° 23' 23" W a distance of 300.59 feet to
the beginning of a tangent curve to the left having a radius of 1,390.00 feet;
23. Thence along the arc of a curve to the left, through a central angle of 03 44' 34" a
distance of 90.80 feet whose chord bears S 03° 27' 29" E a distance of 90.80 feet to a
point on the North line of a property exhibit prepared by Cardinal Land Surveying, Inc.
on September 3, 2003;
24. Thence N 89° 13' 11" W along said North line a distance of 80.07 feet to the beginning
of a non - tangent curve to the left having a radius of 1,310.00 feet;
25. Thence along the arc of a curve to the left, through a central angle of 28 29'08" a
distance of 651.29 feet whose chord bears N 15° 58' 27" W a distance of 644.60 feet;
26. Thence N 30° 13' 01" W a distance of 827.03 feet;
27. Thence S 24° 28' 35" W a distance of 1,802.16 feet;
28. Thence N 86° 38' 28" W a distance of 424.37 feet to a point on the Westerly Right of
Way line of Interstate Highway No. 25 (formerly U.S. Highway No. 85 -87);
29. Thence N 03° 22' 25" E, along said Westerly Right of Way line, a distance of 997.77
feet (Existing City Limits Line);
30. Thence S 86° 38' 28" E a distance of 98.19 feet (Existing City Limits Line);

32. Thence S 86° 38' 28" E a distance of 324.00 feet, to the Southwesterly corner of said
Minnequa Industrial Park, Second Filing (Existing City Limits Line);
33. Thence N 24° 28' 35" E, along the Southeasterly line of said Minnequa Industrial Park,
Second Filing, a distance of 1,679.82 feet to the Point of Beginning (Existing City Limits
Line);
Said Parcel contains 33.94 acres, more or less.
BASIS OF BEARINGS
Bearings are based on the North line of Section 20, Township 21 South, Range 64 West from the
Northwest corner (found monument with a 3 Yd' aluminum cap, L.S. #33651) to the Northeast
corner (found monument with a 3 Yd' aluminum cap, L.S. #33651) to bear S 89 23'07" E.
SECTION 2.
A public hearing to determine if the area proposed to be annexed meets the applicable
requirements of C.R.S. §31 -12 -104 and C.R.S. §31 -12 -105 to establish eligibility for annexation
under the Municipal Annexation Act of 1965 shall be held before the City Council in Council
Chambers, Second Floor, City Hall, One City Hall Place, Pueblo, Colorado on Monday, September
12, 2005, commencing at 7:00 p.m. or as soon thereafter as City Council business allows. The
City Clerk shall publish notice of the public hearing once a week for four successive weeks in the
Pueblo Chieftain. The first publication of such notice shall be at least thirty (30) days prior to the
date of the hearing. A copy of the published notice, together with a copy of the Petition for
Annexation, shall be sent by registered mail by the City Clerk to the Board of County
Commissioners and the County Attorney of Pueblo County and to any school district or special
district having territory within the area to be annexed at least twenty five days prior to the date of
the hearing.

ISSUE
Shall the City Council approve and adopt findings and determination concerning
the proposed annexation?
RECOMMENDATION
Approval of the Resolution.
BACKGROUND
The Rocky Mountain Steel Annexation Phase 1 submitted by Rocky Mountain
Steel Mills comprises 33.94 acres located west of Lime Road and southeast of
the Interstate 25 and Pueblo Boulevard interchange. This annexation petition is
the first in a series of four phased annexations of property into the City of Pueblo
that comprise the flag pole extension of city boundaries which enable the
annexation of the Xcel Energy property into the City of Pueblo. This Resolution
determines that the Petition for Annexation is found and determined to be in
substantial compliance with the provisions of the Colorado Revised Statutes 31-
12- 107(1). A public hearing is scheduled for September 12, 2005 to determine if
the area proposed to be annexed meets the applicable requirements of C.R.S.
31 -12 -104 and 31 -12 -105 to establish eligibility for annexation under the
Municipal Annexation Act of 1965. It also directs the City Clerk to publish notice
of public hearing once a week for four successive weeks in the Pueblo Chieftain.
By approving the attached resolution City Council finds the annexation petition is
in substantial compliance with state annexation statutes and sets the date of
September 12, 2005 for a public hearing. The date for the first presentation of
the Ordinance for Annexation is scheduled for August 22, 2005.
FINANCIAL IMPACT
The filing of the annexation petition and this Finding of Substantial Compliance
does not result in any direct financial impact to the City of Pueblo.
