A RESOLUTION DIRECTING THE CITY ADMINISTRATION TO EVALUATE THE
POSSIBLE ACQUISITION OF ALL OR PART OF AQUILA INC.'S FACILITIES
WITHIN OR WITHOUT THE CITY LIMITS UNDER ARTICLE IX OF FRANCHISE
ORDINANCE NO. 5222, TRANSFERRING FUNDS FOR THE PURPOSE OF SAID
EVALUATION, AND REPEALING RESOLUTION NO. 10398
WHEREAS, Aquila, Inc. has advised the City that its facilities used in providing
electric services in Colorado may be for sale and invited the City to participate in bidding for
the possible acquisition thereof, and
WHEREAS, the proposed bidding procedures and time frames with respect thereto
as well as the constraints of a proposed confidentiality agreement are less advantageous to
the City than proceeding under Article IX of Franchise Ordinance No. 5222 to acquire such
facilities. NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The City Council hereby finds and determines that it would be in the best interest of the City
and its citizens and in furtherance of the public health, benefit safety, and welfare for the City to
evaluate the possible acquisition of all or part of Aquila, Inc.'s facilities within or without the City
limits under Article IX of Franchise Ordinance No. 5222 instead of participating in the proposed
bidding for the possible acquisition of such facilities.
SECTION 2.
The City administration is directed to evaluate the possible acquisition of Aquila's facilities
under Article IX of the Franchise Ordinance No. 5222.

Funds in the amount of $120,000 shall be transferred from account CPO505 "Vehicle
Replacement," and funds in the amount of $21,921 shall be transferred from account CP0599
"Capital Projects to be Determined" into Capital Project CP0510 "Aquila Acquisition."
SECTION 4.
Funds in the amount of $141,921 transferred in Section 3 above to account CP0510 "Aquila
Acquisition" shall be used to engage the services of independent consultants to evaluate the
possible acquisition of Aquila's facilities, and the City Manager is authorized to select and contract
with such consultants.
SECTION 5.
Upon completion of the evaluation, an Ordinance referring the acquisition of Aquila's
facilities to the voters of the City of Pueblo shall be presented to City Council for first reading no
later than August 8, 2005.
SECTION 6.
Resolution No. 10398 is hereby repealed.
