A RESOLUTION AUTHORIZING THE ISSUANCE OF A REVOCABLE PERMIT TO LEGACY
BANK FOR THE USE OF THE PUBLIC RIGHT OF WAY ON THE SOUTH SIDE OF 101 NORTH
MAIN STREET
WHEREAS, Legacy Bank has applied for a Revocable Permit for the use of the public right
of way on the First Street (south) side of 101 North Main Street to accommodate a stairwell fire
exit; and
WHEREAS, Legacy Bank acknowledges that it is responsible for landscape maintenance of
said area; and
WHEREAS, Legacy Bank acknowledges that said stairwell fire exit shall be required to be
relocated should the City widen First Street for any other reason;
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The attached Revocable Permit is authorized to be issued to Legacy Bank for the use of the
public right of way on the south side of 101 North Main Street for the purpose of accommodating a
stairwell fire exit and a masonry planter.
SECTION 2.
The use of the public right -of -way granted hereby is subject to all limitations, terms and
conditions set forth in the attached Revocable Permit.

TITLE
A RESOLUTION AUTHORIZING THE ISSUANCE OF A REVOCABLE PERMIT TO
LEGACY BANK FOR THE USE OF THE PUBLIC RIGHT OF WAY ON THE SOUTH
SIDE OF 101 NORTH MAIN STREET
ISSUE
Should City Council issue a Revocable Permit to Legacy Bank for the use of the public
right -of -way located on the south side of 101 North Main Street to accommodate a
stairwell fire exit and a masonry planter.
RECOMMENDATION
The Revocable Permit Review Committee recommends that City Council approve this
request.
BACKGROUND
Legacy Bank has requested the use of the right of way located on the First Street
(south) side of 101 North Main Street to accommodate a stairwell fire exit from the
basement floor of the building. Applicant understands that it will become the
responsibility of Legacy Bank to maintain the landscaping in the right of way area
covered under this permit. Legacy Bank also understands that if the City decides to
widen First Street in the future, the stairway will need to be relocated to the Central
Plaza side of the building. See attached letter from Andrew P. Trainor, Executive Vice
President.
