HomeMy WebLinkAbout10386RESOLUTION NO. 10386 A RESOLUTION AUTHORIZING THE ISSUANCE OF REVOCABLE PERMIT TO TOM'S CAR WASH FOR THE USE OF THE PUBLIC RIGHT OF WAY AT 2222 WEST 18 STREET. BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The attached Revocable Permit is authorized to be issued to Tom's Car Wash for the use of the public right of way at 2222 West 18 Street for the purpose of installing a business sign. SECTION 2. The use of the public right -of -way granted hereby is subject to all limitations, terms and conditions set forth in the attached Revocable Permit. ISSUE Should City Council issue a Revocable Permit to Tom's Car Wash for the use of the public right -of -way located at 2222 West 18 Street for placement of a business sign. RECOMMENDATION The Revocable Permit Review Committee recommends that City Council DENY this request. The Committee instead recommends that City Council grant a 5- year permit to allow the property owner adequate time to relocate said sign. BACKGROUND As a result of recent construction in the area, it was determined that the existing business sign for Tom's Car Wash is located in the right of way adjacent to 2222 West 18 Street. City staff has issued a notice to relocate the sign. There is sufficient area to erect a sign that meets the City of Pueblo sign regulations within the property lines of this business. Allowing the sign within the public right of way is not necessary as there are feasible on -site alternatives. Tomas Crain, the owner has indicated former City staff authorized the installation of the sign within the right of way. In discussions with Carl Olson, former Zoning Director, Mr. Olson indicated he did not authorize such placement because that was not within his purview. The 1998 sign permit does not show authorization of sign placement within the right of way. If the permit would have indicated such authorization, the Revocable Permit Review Committee would have recommended an unlimited permit until the property is sold, such as recently done for Mario & Joseph Bassi on Constitution. FINANCIAL IMPACT None.
