HomeMy WebLinkAbout10359RESOLUTION NO. 10359 A RESOLUTION AUTHORIZING THE ISSUANCE OF A REVOCABLE PERMIT TO MARIO & JOSEPHINE BASSI FOR THE USE OF THE PUBLIC RIGHT OF WAY AT 1720 CONSTITUTION ROAD BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The attached Revocable Permit is authorized to be issued to 1720 Constitution Road for the use of the public right of way at 1720 Constitution Road for the purpose of installing a business sign. SECTION 2. The use of the public right -of -way granted hereby is subject to all limitations, terms and conditions set forth below and in the attached Revocable Permit. 1. Sale of the property will cause the permit to be automatically revoked. 2. A change in the sign cabinet or support structure, and /or any change other than routine maintenance or sign faces, will cause the permit to be automatically revoked. 3. If the street is widened or other public improvements are installed in the in the right of way, or for any other reason, City Council may revoke this permit at any time in the future. ISSUE Should City Council issue a Revocable Permit to Mario and Josephine Bassi for the use of the public right -of -way located at 1720 Constitution Road for placement of a business sign. RECOMMENDATION The Revocable Permit Review Committee recommends that City Council approve this request with conditions. The Committee recommends that City Council grant a permit conditioned such that: 1. Sale of the property will cause the permit to be automatically revoked. 2. A change in the sign cabinet or support structure, and /or any change other than routine maintenance or sign faces, will cause the permit to be automatically revoked. 3. If the street is widened or other public improvements are installed in the right of way or for any other reason, City Council may revoke this permit at any time in the future. BACKGROUND The existing business sign at 1720 Constitution Road is within the City right of way. City staff issued a notice requiring removal of said sign. The property owners are requesting a Revocable Permit based on the long -term existence of the sign in its current location. It appears City staff approved the sign permit issued when the sign was originally installed in 1989. Given that a sign permit was issued in spite of the sign's location in the right of way, staff is recommending, in this particular case only, that a compromise solution be offered, which grants conditional approval of this Revocable Permit FINANCIAL IMPACT None.
