HomeMy WebLinkAbout10348RESOLUTION NO. 10348 A RESOLUTION AUTHORIZING THE ISSUANCE OF A BUILDING PERMIT TO PUEBLO COUNTY FOR CONSTRUCTION OF THE JAIL EXPANSION PROJECT PRIOR TO THE RECORDING OF THE JUSTICE PLAZA SUBDIVSION BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1 Due to exigent circumstances, contemporaneously with the filing of a complete subdivision application meeting all of the requirements of Chapter 4, Title XII of the Pueblo Municipal Code as determined by the Director of Public Works ( "Subdivision ") for the property owned by Pueblo County located on the west side of the 900 Block Court Street ( "Property "), the City administration is authorized to approve the issuance of a building permit for a building or structure to be constructed or installed on the Property ('Building Permit'). SECTION 2. The Building Permit will be deemed to be revoked and cancelled if the owner of the Property does not diligently pursue the Subdivision to final approval. No certificate of occupancy shall be issued for any building or structure constructed or installed on the Property pursuant to the Building Permit until after the Subdivision and the appropriate City of Pueblo Development Standards per the Planning and Zoning Commission conditions of approval for Case NO. GU -04- 03 have been finally approved by City Council. The conditions, restrictions and limitations set forth herein shall be incorporated in and made a part of the Building Permit. TITLE A RESOLUTION AUTHORIZING THE ISSUANCE OF A BUILDING PERMIT TO PUEBLO COUNTY FOR CONSTRUCTION OF THE JAIL EXPANSION PROJECT PRIOR TO THE RECORDING OF THE JUSTICE PLAZA SUBDIVISION ISSUE Should City Council issue a building permit to the Pueblo County for construction of the jail expansion project prior to the recording of the subdivision. RECOMMENDATION Approval of this Resolution BACKGROUND In an effort to begin construction, the Pueblo County Department of Public Works is requesting approval by the City Council to allow staff to sign off on the building permit prior to a recorded subdivision and completion of City Development Standards per Planning & Zoning conditions of approval for Case No. GU -04 -03 (see attached P &Z minutes dated October 13, 2004 for Case No. GU- 04 -03). This resolution will authorize City administration to approve the issuance of a building permit prior to City Council approval of subdivision plat, but subsequent to submittal of all documents indicating compliance with P &Z conditions. The building permit will be revoked and cancelled if the owner of the property does not diligently pursue these conditions. No certificate of occupancy shall be issued for any building or structure associated or installed on the property until after the subdivision has been approved by City Council and conditions of P &Z Case No. GU -04 -03 have been fulfilled.
