A RESOLUTION OF INTENT TO ESTABLISH A RESIDENTIAL RECYCLING PROGRAM,
IMPOSE A RESIDENTIAL RECYCLING SERVICE FEE ON ALL RESIDENCES IN THE CITY
OF PUEBLO, AND REQUIRE THE USE OF RESIDENTIAL RECYCLING SERVICES
WHEREAS, recycling of materials and products will decrease the amount of materials
and products which is disposed of in landfills and will also spur economic development in the
recycling industry; and
WHEREAS, recycling of materials and products will benefit the public welfare by
reducing the consumption of important, non - renewable natural resources, as well as the amount
of land required for disposal of solid waste in landfills, thereby helping to extend the longevity of
these natural resources and landfills. NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
The City Council does hereby express its intent to establish a residential recycling
program and to impose a fee on all residences within the City to finance such program.
SECTION 2
The proposed residential recycling program includes the collection, transportation,
processing and marketing of recyclable materials and products from residences within the City.
Each residence in the City will be required to use the recycling services unless the residence
prefers to use the recycling services provided by a private person. The term "residences" does
not include multifamily residences of eight or more units or industrial or commercial
establishments.
SECTION 3
The City Council proposes to conduct the residential recycling program through the use
of contractors and not by City staff or equipment and hereby authorizes City administration to
request proposals from qualified persons to provide such services.
SECTION 4
City Council intends to commence the imposition of the fee for and require the use of the
recycling services on or after August 1, 2005. The City Clerk is directed to provide notice to
persons who lawfully provide waste services in the City and give a six -month public notice in
The Pueblo Chieftain Such notices shall be substantially in the form and content of the Public
Notice attached hereto.
SECTION 5
City Council intends to establish and impose the recycling service fee by ordinance in an
amount sufficient to finance all costs of the residential recycling program and services based
upon the proposals received by the City from qualified persons to provide the recycling and
processing services.
SECTION 6
This Resolution shall become effective upon final approval and passage.

ISSUE
Should City Council adopt a Resolution expressing its intent to impose a fee on all
residences in the City to finance a residential recycling program and require the
residences to use the recycling services?
RECOMMENDATION
None.
BACKGROUND
The proposed residential recycling program includes the collection, transportation,
processing and marketing of recyclable materials and products from residences
within the City. Each residence will be require to use the services unless the
residence prefers to use the recycling services provided by a private person. The
term "residences" does not include multifamily residences of eight or more units or
industrial or commercial establishments. The City Council must by statute give
notice to persons who lawfully provide waste services and publish a six -month
public notice prior to requiring the use or initial imposition of a residential recycling
service fee. The residential recycling services will be provided by the City through
qualified contractors selected by the City pursuant to requests for proposals.
FINANCIAL IMPACT
The City Council would by ordinance impose a fee for residential recycling services
on the residences in the City in an amount sufficient to finance all costs of the
residential recycling services based upon contractors' responses to City's request
for proposals to provide such services. The very preliminary estimated fee would
be between $1.50 and $3.50 per month for each residence in the City.
PUBLIC NOTICE
PUBLIC NOTICE is hereby given pursuant to Section 30 -15- 401(7.5), C.R.S. that the City
of Pueblo, Colorado will on or after August 1, 2005, subject to adoption of appropriate ordinances
and contracting with qualified contractors, require the use of and commence the imposition and
billing of a fee for residential recycling services throughout the City of Pueblo.
Any person may, within thirty days following publication of this Notice or receipt of this
Notice, request in writing addressed to the City Clerk the opportunity to submit a proposal to provide
residential recycling services throughout the City of Pueblo.
