A RESOLUTION APPROVING AND ACCEPTING THE CANVASS AND ABSTRACT OF VOTES
CAST AT THE BANDERA BOULEVARD SPECIAL IMPROVEMENT MAINTENANCE DISTRICT
MILL LEVY ELECTION HELD ON NOVEMBER 2, 2004 (INCLUSION OF PROPERTY INTO
DISTRICT)
WHEREAS, the canvass of the Bandera Boulevard Special Improvement Maintenance
District Mill Levy Election held on November 2, 2004 (Inclusion of Property into District) has been
completed and the Board of Elections has unanimously passed its Resolution certifying the votes
and declaring the results of voting at said Bandera Boulevard Special Improvement Maintenance
District Mill Levy Election; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1 _
The Resolution of the Board of Elections certifying the votes and declaring the results at
said Bandera Boulevard Special Improvement Maintenance District Mill Levy Election, a copy of
which is attached hereto, is hereby approved; and the designation of results therein contained are
hereby accepted and adopted.
SECTION 2
This Resolution shall become effective immediately upon its adoption.

ISSUE
Shall City Council accept and approve the abstract of votes cast at the Bandera Boulevard
Special Improvement Maintenance District Mill Levy Election dated November 2, 2004
(Inclusion of Property into District)?
RECOMMENDATION
Approval of the Resolution.
BACKGROUND
A Petition was filed with the City Cleric to include real property in the Bandera Boulevard Special
Improvement Maintenance District ("District") pursuant to Chapter 9 of Title X11 of the Pueblo
Municipal Code and the real property sought to be included in the District includes the entire
area of the Pastore Ranch Annexation.
Per Ordinance No. 7210, the City Council found and determined that the petition to include real
property in the District meets and complies with the requirements of Section 12 -9-5 of the
Pueblo Municipal Code and was signed by 100% of the persons who own all of the real
property south to be included in the District
The mill levy to be levied against the real property included in the District was submitted to a
vote of the eligible registered electors of the District at an election held on November 2, 2004.
The City Clerk, in oorrt;onnity with the provisions of the Pueblo Election Code, conducted the
Election on November 2, 2004. Pursuant to Section 5- 1- 115(b) of the Municipal Code, the
Members of the Board of Elections met as the Canvassing Board and pursuant to Section 5-1-
119(a) of the Municipal Code, an abstract of votes was prepared by the City Clerk and approved
by the Board of Elections (see attached).

A RESOLUTION CERTIFYING THE VOTES AND DECLARING THE
RESULTS OF VOTING AT THE BANDERA BOULEVARD SPECIAL
IMPROVEMENT MAINTENANCE DISTRICT MILL LEVY ELECTION
HELD ON NOVEMBER 2, 2004 (OFFICIAL SURVEY OF RETURNS)
WHEREAS, the Board of Elections met on November 5, 2004 as the Canvassing Board of the
Bandera Boulevard Special Improvement Maintenance District Mill Levu Election held on November 2,
2004 (inclusion of Property into District), pursuant to Section 5-1 -115 of the Pueblo Municipal Code, as
amended; and
WHEREAS, the Board of Elections proceeded to canvass the votes cast at said Bandera
Boulevard Special Improvement Maintenance District Mill Levy Election and to make an abstract thereof,
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ELECTIONS that:
SECTION 1:
The following votes are unanimously certified:
QUESTION 1:
BALLOT ISSUE APPROVING THE INCLUSION OF REAL PROPERTY WITHIN THE
DISTRICT (Ordinance No. 7210)
YES 1
NO 0
SECTION 2:
Question 1, Inclusion of Real Property into the Special Improvement Maintenance District, the
greatest number of votes was cast FOR the Question; therefore, QUESTION 1 PASSED.
SECTION 3:
The abstract of votes prepared by the City Clerk is hereby approved and each member of the
Board of Elections shall affix hM er signature thereto, certifying same to be correct and shall endorse
and subscribe on such statements their certification of determination required by Section 5- 1- 119(1) of
the Pueblo Municipal Code, as amended.
