HomeMy WebLinkAbout10262RESOLUTION NO. 10262 A RESOLUTION APPROVING AND ACCEPTING THE CANVASS AND ABSTRACT OF VOTES CAST AT THE BANDERA BOULEVARD SPECIAL IMPROVEMENT MAINTENANCE DISTRICT MILL LEVY ELECTION (FIXING MILL LEVY) HELD ON NOVEMBER 2, 2004 WHEREAS, the canvass of the Bandera Boulevard Special Improvement Maintenance District Mill Levy Election (Fixing Mill Levy) held on November 2, 2004 has been completed and the Board of Elections has unanimously passed its Resolution certifying the votes and declaring the results of voting at said Bandera Boulevard Special Improvement Maintenance District Mill Levy Election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1 _ The Resolution of the Board of Elections certifying the votes and declaring the results at said Bandera Boulevard Special Improvement Maintenance District Mill Levy Election (Fixing Mill Levy), a copy of which is attached hereto, is hereby approved; and the designation of results therein contained are hereby accepted and adopted. SECTION 2 This Resolution shall become effective immediately upon its adoption. RECOMMENDATION Approval of the Resolution. BACKGROUND The City Council, as the Governing Body of the Bandera Boulevard Special Improvement Maintenance District, found and determined that the cost of maintaining the public improvements during fiscal year 2005 is estimated to be $6,000.00. The mill levy to be levied upon the taxable real property within the District for the fiscal year 2005, which shall raise the amount required by the District to meet the cost of maintain the public improvements was foxed and determined at five (5) mills. Per Resolution No. 10235, a ballot issue relating to the five (5) mills imposed upon the taxable real property within the District was submitted to a vote of the registered electors of the District at an election held on November 2, 2004. The City Clerk, in conformity with the provisions of the Pueblo Election Code, conducted the Election on November 2, 2004. Pursuant to Section 5- 1- 115(b) of the Municipal Code, the Members of the Board of Elections met as the Canvassing Board and pursuant to Section 5- 1- 119(a) of the Municipal Code, an abstract of votes was prepared by the City Clerk and approved by the Board of Elections (see attached). FINANCIAL IM PACT None A RESOLUTION CERTIFYING THE VOTES AND DECLARING THE RESULTS OF VOTING AT THE BANDERA BOULEVARD SPECIAL IMPROVEMENT MAINTENANCE DISTRICT MILL LEVY ELECTION (FIXING MILL LEVY) HELD ON NOVEMBER 2, 2004 (OFFICIAL SURVEY OF RETURNS) WHEREAS, the Board of Elections met on November 5, 2004 as the Canvassing Board of the Bandera Boulevard Special Improvement Maintenance District Mill Levy Election (Fodng Mill Levy) held on November 2, 2004, pursuant to Section 5-1 -115 of the Pueblo Municipal Code, as amended; and WHEREAS, the Board of Elections proceeded to canvass the votes cast at said Bandera Boulevard Special Improvement Maintenance District Mill Levy Election (Fodng Mill Levy) and to make an abstract thereof; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ELECTIONS that: SECTION 1: The following votes are unanimously certified: QUESTION 1: BALLOT ISSUE RELATING TO THE FIVE MILL LEVY IMPOSED UPON THE TAXABLE REAL PROPERTY WITHIN THE DISTRICT (Resolution No. 10235) YES 5 NO 2 SECTION 2: Question 1, Special Improvement Maintenance District Mill Levy (Fixing Mill Levy); the greatest number of votes were cast FOR the Question; therefore, QUESTION 1 PASSED. SECTION 3: The abstract of votes prepared by the City Clerk is hereby approved and each member of the Board of Elections shall affix his/her signature thereto, certifying same to be correct and shall endorse and subscribe on such statements their certification of determination required by Section 5-1- 119(1) of the Pueblo Municipal Code, as amended.
