A RESOLUTION APPROVING A CONTRACT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL
CORPORATION, AND THE STATE OF COLORADO RELATING TO THE PUEBLO MOUNTAIN
PARK WILDFIRE MITIGATION PROJECT, AND AUTHORIZING THE PRESIDENT OF CITY
COUNCIL TO EXECUTE SAME
WHEREAS, City Council supported a grant application to the Colorado State Forest Service
to secure funding for wildfire mitigation at Pueblo Mountain Park; and
WHEREAS, the City of Pueblo has received a grant from the Colorado State Forest for
wildfire mitigation at Pueblo Mountain Park, subject to the execution of a Contract; and
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The grant Contract and Attachments between the City of Pueblo, a municipal corporation
and the Colorado State Forest Service, relating to wildfire mitigation at Pueblo Mountain Park
(Colorado State Forest Service Grant #G- 536738 -003), copies of which are attached hereto and
incorporated herein, having been approved as to form by the City Attorney, are hereby approved.
SECTION 2.
The President of the City Council is hereby authorized to execute and deliver said Contract
and the Agreement attached thereto in the name of and on behalf of the City of Pueblo, a
Municipal Corporation, and the City Clerk shall affix the seal of the City hereto and attest same.
SECTION 3.
The resolution will become effective upon final passage.

Should the City Council approve a contract between the City of Pueblo and the
Colorado State Forest Service for the Pueblo Mountain Park Wildfire Mitigation
Project?
RECOMMENDATION
Approval of the Resolution.
BACKGROUND
The City will be committing to providing fuel reduction practices on 25 acres
within the eastern 300 acres of Pueblo Mountain Park. The project boundary
contains the south side of the main entrance of the park which will reduce the
possibility of a fire leaving the park area and damaging private homes.
In October of 2003, the City submitted a grant request in the amount of $50,000
to the Colorado State Forest Service for wildfire mitigation actions at Pueblo
Mountain Park (see Attachment A - grant cover page and budget). In July of
2004, the City received notification of a $45,000 grant award from the Colorado
State Forest Service to assist in funding the project. The City Parks Department,
per the grant document as amended by Colorado State Forest Service, will
commit $30,000 of in -kind services to the project which includes $20,000 of
wages and $10,000 for operating and City equipment use.
An ordinance establishing Capital Project No. PL0406, to be known as Pueblo
Mountain Park Wildfire Mitigation Project, in the amount of $90,000 is being
submitted concurrently with this resolution.
The project, which will complete another phase of fire mitigation initiated in 2002,
is scheduled to begin in October of 2004 and be completed in June of 2005,
weather permitting. The estimated budget for the Pueblo Mountain Park Wildfire
Mitigation Project, is as follows:

FINANCIAL IMPACT
The City of Pueblo will obligate $15,000 in cash match from 2004 Conservation
Trust Funds appropriated for Pueblo Mountain Park Forest Management (Project
No. CP0219) and utilize funds to be received in the amount of $45,000 from the
Colorado State Forest Service Western States Wildland Urban Interface Grant
Program, along with $30,000 of City Parks Department in -kind contribution. The
Colorado State Forest Services funds ($45,000) will be used to contract the
cutting and removal of the trees, assist with equipment rental costs, and design
and marking of trees within the project area.

Terms and Conditions
(1) UNIVERSITY hereby awards a cost reimbursable subaward, as described above, to Collaborator. The statement of work and budget for this
subaward are (check one): _ as specified in Collaborator's proposal dated ; or _X_ as shown in Attachment A. In its performance of
subaward work, Collaborator shall be an independent entity and not an employee or agent of UNIVERSITY.
(2) UNIVERSITY shall reimburse Collaborator not more often than monthly for allowable costs. All invoices shall be submitted using the
attached Reimbursement Request form (Attachment B), which shall Include current and cumulative costs (including cost sharing), Subaward
number, and certification as to truth and accuracy of invoice. Invoices must be submitted to District Offices for approval and processing for
payment. Invoices that do not reference UNiVERSITY's subaward number shalf be returned to Collaborator.
(3) A final statement of costs incurred, including cost sharing, marked 'FINAL ", must be submitted to UNIVERSITY's Administrative Contact
NOT LATER THAN sixty (60) days after subaward end date. The final statement of costs shall constitute Collaborators final financial report. Final
payment due the Collaborator may be withheld until all the terns and conditions of the subaward have been met.
(4) All payments shall be considered provisional and subject to adjustment within the total estimated cost in the event such adjustment is
necessary as a result of an adverse audit finding against the Collaborator.
(5) Matters concerning the technical performance of this subaward should be directed to the appropriate party's Project Director, -as shown in
Attachment C. Technical reports are required as shown above, "Reporting Requirements."
(6) Matters concerning the request or negotiation of any changes in the terns, conditions, or amounts cited in this subaward agreement should
be directed to the appropriate party's Administrative Contact, as shown in Attachment C. Any such changes made to this subaward agreement
require the written approval of each party's Authorized Official, as shown in Attachment C.
(7) Each party shall be responsible for its negligent acts or omissions and the negligent acts or omissions of its employees, officers, or
directors, to the extent allowed by law.
(8) Either party may terminate this agreement with thirty days written notice to the appropriate party's Administrative Contact, as shown in
Attachment 3. UNIVERSITY shall pay Collaborator for termination costs as allowable under OMB Circular A -21 or A -122, as applicable.
(9) No -cost extensions require the approval of the UNIVERSITY. Any requests for a no -cost extension should be addressed to and received by
the Administrative Contact, as shown in Attachment C, not less than thirty days prior to the desired effective date of the requested change.
(10) The Subaward is subject to the terms and conditions of the Prime Award, Attachment D, and other special terms and conditions, as
Identified in Attachment E.
(11) By signing below Collaborator makes the certifications and assurances shown in Attachments F.

The City of Pueblo will work with the other supporting agencies to finalize the tree thinning boundary
and then contract out the thinning of the 25 -acre area within a 300 -acre area of the park. The trees to
be removed will be marked by the State Forest Service. The contractor will follow the FireWise and
CSFS standards for fuelbreaks. Slash will be chipped or treated by the park department employees.
Give a brief description of the project steps and activities to achieve objectives.
The City of Pueblo will coordinate with the CSFS to establish the fuelbreak boundaries and mark the
ees to be removed; contract will be awarded to thin fuelbreak areas and remove trees; City perk
crews will coordinate the chipping or slash disposal of the understory materials.

Additional Comments
The City of Pueblo in cooperation with the Beulah Valley Mitigation Council, Beulah Fire District,
Pueblo County Office of, Emergency Management and the State Forest Service have developed a fire
mitigation plan and strategy that is being implemented to reduce damage to Pueblo Mountain Park
and local homes in event of a wildland fire. This request is in compliance with the plan and will

complete another phase of the project which was started in 2002.
