DELIVER AN APPLICATION TO THE DEPARTMENT OF LOCAL AFFAIRS FOR STATE
ENERGY AND MINERAL IMPACT ASSISTANCE PROGRAM FUNDS TO ASSIST IN FUNDING
THE UTILITY SEPARATION AND CODE COMPLIANCE IMPROVEMENTS FOR THE
BESSEMER HISTORICAL SOCIETY'S, CF &I HEADQUARTERS PROPERTY AND ASSIGNING A
LOCAL PRIORITY OF 1 OF 2
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The President of the City Council is hereby authorized to execute and deliver the attached
application requesting State Energy and Mineral Impact Assistance Funds in the name of the City,
to the Department of Local Affairs to partially fund the utility separation and code upgrade for
property leased by the City from the Bessemer Historical Society in the amount of $500,000.

Should the City Council submit an Energy and Mineral Impact Assistance Fund
application to the Department of Local Affairs requesting financial assistance to help fund
the utility separation and code upgrade for the property it leases from the Bessemer
Historical Society?
RECOMMENDATION
Approve the Resolution.
BACKGROUND
In 2001, the City of Pueblo requested and received funding from the Department of Local
Affairs through the Energy and Mineral Impact Assistance Fund to assist the Bessemer
Historical Society (BHS) in the acquisition of the CF &I Headquarters Building. This
assistance allowed the City to enter into a five -year lease for a portion of the former CF &I
Headquarters property, thus providing BHS the funds necessary to acquire the property.
The acquisition of the building subsequently triggered the transfer of the CF &I archives to
BHS. As a part of the purchase agreement, BHS is required to separate the utilities that
serve the building from the remainder of the plant and to install new meters. These
utilities include electrical service and a new water tap. With these new services, the
building code requires that the existing electrical, water, plumbing, and mechanical
systems be brought into compliance with the code. BHS estimates that this is a
$1,906.050 project. The City of Pueblo is leasing a portion of the facility for five years
and as the lessee the City is requesting $500,000 from the Department of Local Affairs to
assist in funding these costs. BHS will provide the match in the amount of $1,406,050
from various sources.
FINANCIAL IMPACT
No direct financial impact. BHS will provide the match for the grant. Depending upon the
source of the funds awarded by the Department of Local Affairs, these funds may or may
not be exempt from TABOR. There is also a provision within the Department of Local
Affairs' contract that requires, should the City be required to refund any money under
TABOR, the City would be required to return the grant funds to the Department of Local
Affairs first.
