HomeMy WebLinkAbout10184RESOLUTION NO. 10184 A RESOLUTION APPROVING SUPPLEMENTAL AGREEMENT NO. 1 TO THE LEASE AGREEMENT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE UNITED STATES OF AMERICA AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME WHEREAS, the City of Pueblo, a Municipal Corporation, and the United States of America entered into a Lease Agreement on May 24, 2004 relating to the lease of office and related space in the terminal building at the Pueblo Memorial Airport; and WHEREAS, both parties wish to amend the provisions of the Lease Agreement as set forth in Supplemental Agreement No. 1; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. A certain Supplemental Agreement No. 1, a copy of which is attached hereto and made a part hereof by reference, after having been approved as to form by the City Attorney, by and between the City of Pueblo, a Municipal Corporation, and the United States of America relating to the lease of office and related space at the Pueblo Memorial Airport, is hereby approved, subject to the conditions as set forth in said Supplemental Agreement No. 1. SECTION 2. The President of City Council is hereby authorized to execute said Supplemental Agreement No. 1 on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the Seal of the City thereto and attest the same. RECOMMENDATION Approval of this Resolution. BACKGROUND City Council approved a Lease Agreement between the City and the United States of America on May 24, 2004 for office and related space in the terminal building at the Pueblo Memorial Airport. The lease space is for the Transportation Security Administration (TSA) screeners. The U.S. General Services Administration, who manages the leases for the federal government, has requested that the commencement date on the lease be changed to August I' The reason for the request is to coincide with the expiration of the Right of Entry Agreement that is still in effect. All other terms and conditions of the lease will remain unchanged. FINANCIAL IMPACT None. Pueblo, CO 81001 Tim AGREEMENT, made and entered into this date by and between City of Pueblo, a Municipal Corporation, whose address is Pueblo Memorial Airport 31201 Bryan Cr. Pueblo, CO 81001 hereinafter called the Lessor, and the UNITED STATES OF AMERICA, hereinafter called the Government: WHEREAS, the parties hereto desire to amend the above Lease, to amend the above lease. NOW THEREFORE, these parties for the considerations hereinafter mentioned covenant and agree that the said Lease is amended, effective August 1, 200 as follows: In reference to the lease agreement. The paragraph indicating the lease duration is deleted and replaced as follows: "To have and hold the same unto the said Lessee for a term of five (5) years commencing on August 1, 2004, subject to cancellation of the lease on or after August 2, 2006, upon 30 days prior written notice to the Lessor, at and for a rental of $21.93 per square foot per annum for the first 24 months of the lease term and for a rental of $16.50 per foot per annum for the last thirty -six (36) months of the lease tetra. Government payment is set forth in General Clause 22, 552.232 -75, titled "Prompt Payment ". All other terms and conditions of the lease shall remain in force and effect.
