HomeMy WebLinkAbout10172RESOLUTION NO. 10172 A RESOLUTION AMENDING THE LEGISLATIVE PROCEDURES AND RULES OF COUNCIL BY THE ADDITION OF A NEW ARTICLE 35 THERETO RELATING TO MATERIAL APPEARING ON PUBLIC AND GOVERNMENT ACCESS CABLE TELEVISION CHANNELS WHEREAS, public and government access cable television channels are for the purpose of informing the public relating to activities of the City and providing a public community forum for dissemination of non - commercial speech, and WHEREAS, reasonable restrictions on use of public and government access cable television channels by or concerning incumbent councilpersons promotes fair campaign practices and is consistent with the appropriate non - commercial use of such channels, and WHEREAS, restrictions on use of public and government access cable television channels for a limited period of time prior to elections by or concerning incumbent councilpersons have no discernable impact on dissemination of political speech because of the availability of numerous other media for such expression including paid political advertising on local commercial broadcast stations, all of which are carried on the same cable television system as the public and government access channels, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicate matter deleted, underscoring indicates matter added) SECTION 1 _ The Legislative Procedures And Rules Of City Council are hereby amended by the addition of the following new Article 35 thereto: 35. Governmental and Public Access Television Channels All material containing the image and /or statements of an incumbent member of the City Council who intends to seek election to any public office including reelection as a member of the Citv Council shall not be aired or presented on anv government or public access cable television channel subject to control by the City of Pueblo within sixty (60) days immediately preceding the election at which the incumbent member of the City ncil seeks to be elected. This prohibition shall not be applicable to airina of reaular or special meetings of the City Council and associated informational material on councilpersons, nor to events at which a councilperson's image and /or statements are of relativelv short duration and incidental to the material beina aired or presented. such as way of example, the Colorado state fair parade. The President of the City Council is authorized and directed to take all appropriate means necessary to enforce this Article. SECTION 2_ This Resolution shall become effective upon final passage and approval. EVETT, CITY MANAGER DAVE GALLI, DEPUTY CITY MANAGER TITLE A RESOLUTION AMENDING THE LEGISLATIVE PROCEDURES AND RULES OF COUNCIL BY THE ADDITION OF A NEW ARTICLE 35 THERETO RELATING TO MATERIAL APPEARING ON PUBLIC AND GOVERNMENT ACCESS CABLE TELEVISION CHANNELS ISSUE This resolution will add a new article to the legislative procedures and rules of the City Council pertaining to the use of the Public and Government Access television channels. This resolution prohibits the use of images and/or statements of any incumbent member of the City Council who intends to seek election to any public office, including reelection as a member of the City Council, on the Government and Public Access cable television channels for a period of sixty (60) days immediately preceding the election. This restriction does not apply to the televising of City Council meetings and work sessions. We believe this restriction will help promote fair campaign practices and is consistent with the non - commercial use prescribed for these channels. RECOMMENDATION This resolution is placed on the agenda at the request of Council Member Chostner. FINANCIAL IMPACT None.
