A RESOLUTION APPROVING A DEED CONVEYING LAND TO TOP LAND DEVELOPMENT AND
AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL TO EXECUTE SAME
WHEREAS, The Pueblo City Council has found and determined that a portion of property
owned by the City and described in the deed attached hereto is excess property because of the
realignment of Lehigh Avenue and surplus to the City's needs; and
WHEREAS, in consideration of this conveyance, and other commitments made in the West
Lee Hills Subdivision for the dedication of parkland for Hudspeth Park which exceeds the eight
percent (8 %) land dedication required by Section 12 -4 -7 of the City Code of Ordinances;
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1 _
The Quit Claim deed dated June 28, 2004 conveying land to Top Land Development, a
copy of which is attached hereto, having been approved by the City Attorney, is hereby approved.
The President of the City Council is hereby authorized to execute the Deed in the name of the City
and the City Clerk is directed to affix the seal of the City thereto and attest same.
SECTION 2.
This Resolution shall become effective upon final passage and approval.

Shall City Council approve a deed conveying land to Top Land Development
and authorize the President of City Council to execute same?
RECO MMENDATION
Approve the Resolution.

In the early 1980s Lehigh Avenue was designated as a minor arterial and was
subsequently redesigned to extend westward through Hudspeth Park. To facilitate the
extension of Lehigh Avenue the City will deed a portion of the Hudspeth Park land to Top
Land Development who will dedicate the right -of -way for Lehigh Avenue within the West
Lee Hills Subdivision. In exchange for the transfer, Top Land Deveelopth the the de dicate
an amount equal to or greater to the public for park purposes a percent
(8 %) park dedication within the West Lee Hills Subdivision. This land will adjoin existing
Hudspeth Park and will allow the park to extend to the arroyo. A similar situation exists in
the Regency Park 15'" Filing and was handled in a similar manner.

This transaction results in a net gain of dedicated parkland to the City. No significant
financial impact to the City of Pueblo is associated with this transfer.
