HomeMy WebLinkAbout10153RESOLUTION NO. 10153 A RESOLUTION APPROVING THE GRANTING OF A CONSERVATION EASEMENT FROM THE CITY OF PUEBLO TO THE PUEBLO COUNTY HISTORICAL SOCIETY FOR THE GOODNIGHT BARN PROPERTY, AND AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL TO EXECUTE SAME AND ALL OTHER DOCUMENTS ASSOCIATED THEREWITH WHEREAS, the City has approved an agreement for the purchase of 1.5 acres of land which includes the structure commonly known as the Goodnight Barn using a grant from the Colorado State Historical Fund ( "SHF ") and City matching funds; and WHEREAS, as part of the SHF grant, the City is required to grant a conservation easement on the property; and WHEREAS, the Pueblo County Historical Society, a local qualified non - profit organization, has agreed to accept the conservation easement and monitor the property in accordance with the easement. NOW, THEREFORE; BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 The Conservation Easement to the Pueblo County Historical Society for Parcel B in Subdivision Exemption 2003 -006 containing 1.5 acres and commonly known as the Goodnight Barn, a copy of which is attached hereto, having been approved by the City Attorney as to form, is hereby approved. SECTION 2 The President of City Council is hereby authorized to execute and deliver the Conservation Easement in the name of the City and to execute all other documents required therefore. The City Clerk is directed to affix the seal of the City to the Conservation Easement and attest same. SECTION 3. The resolution will become effective upon final passage. RECOMMENDATION Approval of the Resolution. BACKGROUND On August 1, 2003 the City entered into a grant agreement with the Colorado State Historical Society to received funds in the amount of $165,000 to be used for the purchase of the Goodnight Barn. On April 26, 2004, City Council approved the purchase of the 1.5 acres Goodnight Bam property from Continental Materials, Inc. and the purchase of the property was completed on June 4, 2004. As part of the State Historical Society grant, the City is required to grant a Conservation Easement (attached) to a qualified preservation organization. The easement restricts the future development of the property and limits uses that would impact the property's historical values in perpetuity. The Pueblo County Historical Society, a local qualified non - profit preservation organization, has agreed to accept the easement. The Pueblo County Historical Society will inspect and monitor the property to verify that the requirements of the easement are being followed. FINANCIAL IMPACT The terms of the conservation easement require the City to maintain the building in state of repair as it existed on the date the easement is executed and maintain property insurance covering those aspects of the property that are governed by the conservation easement. The estimated annual cost of the property insurance is $400.00.
