A RESOLUTION APPROVING A CONTRACT
MODIFICATION BETWEEN PUEBLO, A MUNICIPAL
CORPORATION, BOARD OF COUNTY COMMISSIONERS
OF PUEBLO COUNTY, COLORADO AND THE HUMANE
SOCIETY OF THE PIKES PEAK REGION RELATING TO
THE OPERATION OF THE ANIMAL SHELTER AND
ENFORCEMENT OF ANIMAL CONTROL ORDINANCES
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
The Contract Modification dated as of January 1, 2004 between Pueblo, a Municipal
Corporation, the Board of County Commissioners of Pueblo County, Colorado and the
Humane Society of the Pikes Peak Region relating to compensation for calendar year
2004, a copy of which is attached hereto, having been approved as to form by the City
Attorney, is hereby approved.
SECTION 2
The President of the City Council is authorized to execute and deliver the Contract
Modification in the name of the City.

TITLE

THE ANIMAL SHELTER AND ENFORCEMENT OF ANIMAL CONTROL

ISSUE
Should the City Council approve the Resolution and Contract Modification fixing
compensation for the calendar year 2004?
RECOMMENDATION
Approve the Resolution.
BACKGROUND
The July 8, 2002 Contract between the City, County, and Humane Society of the
Pikes Peak Region ( "Society ") provides that the compensation to be paid to Society
for operating the animal shelter and enforcing City and County animal control
ordinances is to be agreed upon for calendar year 2004. All parties have agreed
to increase the monthly compensation by $3,448 per month, from $58,334 to
$61,782.
FINANCIAL IMPACT
The Contract Modification requires the City to pay $35,834.00 monthly to the
Humane Society of the Pikes Peak Region which amount is $1,878.00 more than
the City paid in 2003 and is included and appropriated in the City's 2004 Budget.
CONTRACT MODIFICATION
THIS CONTRACT MODIFICATION entered into as of January 1, 2004 between The
Humane Society of the Pikes Peak Region ( "Society "), City of Pueblo ( "City ") and Board of
County Commissioners of Pueblo County, Colorado ( "County"), WITNESSETH
WHEREAS, Society, City and County entered into a Contract dated July 8, 2002 for the
operation of the animal shelter and enforcement of City and County animal control ordinances
( "Contract "), and
WHEREAS, Section II.B. of the Contract requires that all modification of the Contract
including Contract Amount shall be reduced to writing, signed by the parties, and affixed to the
Contract, and
WHEREAS, the parties have agreed to modify the Contract Amount for calendar year
2004,
NOW, THEREFORE, in consideration of the foregoing and mutual covenants contained
herein, Society, City and County agree as follows:
1. The Contract Amount set forth in Article II of the Contract is fixed and established
in the amount of $61,782.00 per month for calendar year 2004.
2. City's share of the Contract Amount for the calendar year 2004 is $35,834.00 per
month and County's share of the Contract Amount for calendar year 2004 is $25,948.00 per
month.
3. Contract as modified by this Contract Modification shall remain in full force and
effect, binding upon and inuring to the benefit of the parties hereto and their respective
successors.
