HomeMy WebLinkAbout10024RESOLUTION NO. 10024 A RESOLUTION APPROVING AMENDMENT NO. 2 TO A FEDERAL GRANT AGREEMENT BETVVEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE FEDERAL AVIATION ADMINISTRATION FOR PROJECT NO. 3-08-0046-22 AND AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL TO EXECUTE SAME WHEREAS, City Council accepted and approved a Federal Aviation Administration Grant for the purchase and installation of security gates and associated computerized monitoring software on August 25, 2003; and WHEREAS, both parties wish to amend the grant to include the acquisition of a handicap passenger lift device; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Amendment No. 2 to the Federal Grant Agreement between the City of Pueblo, a Municipal Corporation, and the Federal Aviation Administration for Project No. 3-08-0046-22, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. Funds in the amount of $35,000 for the acquisition of the handicap passenger lift device have been budgeted in the Airport's Capital Outlay fund. RECOMMENDATION Approval of this Resolution. BACKGROUND City Council approved a Federal Grant on August 25, 2003 for the purchase and installation of security gates and associated computerized monitoring software. The acquisition of the handicap passenger lift device was suppose to be included in the grant but the FAA did not have the funds at that time for the passenger lift. They have since found funding for the lift and want to include it with the current grant. The passenger lift is needed especially for the casino charter flights. Currently, persons in wheelchairs have to be carried up the stairs into the aircraft by airline personnel. Besides posing a safety hazard, the airport is not in compliance with FAA standards regarding the loading of passengers and could possibly lose the charter flights because of this. FINANCIAL IMPACT The passenger lift is estimated to cost around $35,000. Funds for the passenger lift were budgeted in the Airport's Capital Outlay budget. The FAA's portion of the passenger lift will be 90% or approximately $31,500 and the City's matching funds will be 10% or approximately $3,500. DEPARTMENT OF TRANSI RTATION FEDERAL AVIATION ADMINISTRATION Page 1 of 2 Pages Contract No. DOT-FA03NM-1097 Pueblo Memorial Airport Pueblo, Colorado AMENDMENT NO. 2 TO GRANT AGREEMENT FOR PROJECT NO. 3-08-0046-22 WHEREAS, the Federal Aviation Administration (hereinafter referred to as the "FAA") has determined it to be in the interest of the United States that the Grant Agreement between the FAA, acting for and on behalf of the United States, and the City of Pueblo, Colorado (hereinafter referred to as the "Sponsor"), accepted by said Sponsor on the 25th day of August, 2003, to be amended as hereinafter provided. NOW, THEREFORE, WITNESSETH: That in consideration of the benefits to accrue to the parties hereto, the FAA on behalf of the United States, on the one part, and the Sponsor, on the other part, do hereby mutually agree that said Grant Agreement be and hereby is amended as follows: That the described airport development now included in said Grant Agreement is hereby revised to add "Acquire Handicap Passenger Lift Device". The revised description becomes "Install Security Access Gates, Acquire Handicap Passenger Lift Device". This offer to amend the described airport development shall expire unless this amendment has been accepted by December 19, 2003. All other terms and conditions of the Grant Agreement remain in full force and effect.
