HomeMy WebLinkAbout10014RESOLUTION NO. 10014 A RESOLUTION AMENDING RESOLUTION NUMBER 9729 ADOPTING A FEE SCHEDULE FOR APPLICATIONS FOR REZONINGS, SUBDIVISIONS, ANNEXATIONS AND MATTERS BROUGHT BEFORE THE ZONING BOARD OF APPEALS AND THE LAND USE ADMINISTRATION DEPARTMENT AND PROVIDING EXEMPTIONS THERETO WHEREAS, Sections 17-5-38, 17-6-5 and 12-4-8 of the Pueblo Municipal Code provide that City Council shall by Resolution establish a schedule of fees, charges and expenses for applications before the Zoning Board of Appeals, the Planning and Zoning Commission and the City Council; and WHEREAS, the Pueblo City Council hereby finds and determines that the following fee schedule is fair and reasonable in relation to the cost and expense, both direct and indirect, in providing the identified services and processing the application. BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: (Brackets indicate matter deleted, underlining indicate matter added) SECTION 1. Section 3 of Resolution 9729 is hereby amended by the following additions to the schedule of fees for applications and certificate requests made to the Department of Land Use Administration (verbal response - no charge): Zoning Review: Residential Detached Garaqes & Carports $25 Sinqle Family Homes $25 Awninq Permits $25 Commercial Parkinq Lots: Includes landscaping, access, dimensional info & liqhtinq $200 Commercial Buildings: Includes landscaping, parking, dimensional info & lighting $200 Multi-family Review: Includes landscaping, parkinq, dimensional info & lightin.q $200 Landscape Verification Including Business/Liquor License: 1st visit 2nd visit 3 or more visits Li.qhtinq Plan Review: Applies when exterior li.qhtin.q is the only proposed chanqe to the site Large Scale Development Review: Includes landscaping, parking, dimensional info & lighting No Char.qe $150 $300 $50 $1,000 1st 100,000 sf $500 each additional 50,000 sf or portion thereof Demolition Sign-off: For properties in all districts except R-l, R-2 and R-3 $150 SECTION 2. Section 4 of Resolution 9729 is hereby amended by the following addition to the schedule of fees for applications and certificate requests made to the Historic Preservation Commission: Demolition Permit Sign-Off $150 SECTION 3. Section 5 of Resolution 9729 is hereby amended to read as follows: [Upon a written finding of good cause, the City Manager may waive ail or any portion of any fee in this Resolution.]. The City of Pueblo is hereby exempt from the payment of fees established by this Resolution and Resolution Number 9729. SECTION 4. This Resolution shall become effective upon final passage and approval and shall apply to all applications filed after the close of business on December 31, 2003. RECOMMENDATION The Planning and Zoning C(~ ~mr~is,sion vote? unanimously to:,recommend approval. BACKGROUND Currently there are no fees for the required development review requirements under Title 17, Zoning, and it has become evident that additi,onaI technical assistance within the Land Use Administration Department is necessary to adequately serve the public. Currently there are two professional positions: the Director and 1 Senior Land Use Planner for a community of approximately 105,000. A third professional position has been approved in the FY2004 budget. The proposed fee schedule acknowledges and partially compensates for a portion of the cost of services provided by the Land Use Department and charges only those using the development review process. FINANCIAL IMPACT The proposed Fee Schedule will annually generate an estimated $105,000.00 in additional revenues for the City, which will compensate for the new professional level staff employees while only partially covering the costs incurred by the City staff for the review of the existing requirements under Title 17, Zoning.
