HomeMy WebLinkAbout09729RESOLUTION NO. 9729 A RESOLUTION ADOPTING A FEE SCHEDULE FOR APPLICATIONS FOR REZONINGS, SUBDIVISIONS, ANNEXATIONS, AND MATTERS BROUGHT BEFORE THE ZONING BOARD OF APPEALS AND THE LAND USE ADMINISTRATION DEPARTMENT AND REPEALING RESOLUTION NUMBER 5073 WHEREAS, Sections 17 -5 -38, 17 -6 -5 and 12-4 -8 of the Pueblo Municipal Code provide that City Council shall by Resolution establish a schedule of fees, charges and expenses for applications before the Zoning Board of Appeals, the Planning and Zoning Commission and the City Council; and WHEREAS, the Pueblo City Council hereby finds and determines that the following fee schedule is fair and reasonable in relation to the cost and expense, both direct and indirect, in providing the identified services and processing the application. BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1 In addition to all related costs, including postage and legal notices, the following fee schedule is hereby adopted for applications brought before the Planning and Zoning Commission: Annexation $500 + $5 for each additional acre over 10 acres Master Plan $500 + $5 for each additional acre over 10 acres (waived if master plan prepared as a part of annexation) Subdivision Submittal $90 plus $160 per lot (lots 1 - 10) _ $105 per lot (lots 11+) Deferred Filings $90 + $50 per lot Final or Amendment to Recorded Plat $190 Special Area plan & Planned Unit Development (does not include designated open space) Residential $200 1 51 lot + $20 for each additional lot Office /Commercial $200 1 5 ' lot + $30 for each additional lot Industrial $200 1S lot + $30 for each additional lot Mixed Use $300 1" lot + $20 for each additional residential lot + $30 for each additional office /commercial lot +$30 for each additional industrial lot Street Name Change Lot Line Rearrangement Continuation of P &Z Hearing Vacation (per plat) Easement Alley Road Extension of Recordation Deadline Continuation of Hearing Map Amendments /Rezonings $175 $125 $50 $175 $250 (no charge when included with road vacation) $325 $40 $50 A -1_ $90 + $0.65 per acre (0 -100 acres) + 0.40 each additional acres A -2_ $90 + $4 per acre A -3_ $90 + $18 per acre A -4_ $90 + $35 per acre R -1 thru R -6 & R -8 $90 + $75 - 1St acre $20 each additional acre R -7 $90 + $150 1" acre $40 each additional acre 0-1, B -1 thru B-4, & 1 -1 thru 1 -3 $90 + $125 1S acre HB, HARP 1 - HARP 2 $30 each additional acre S -1 thru S-4 $90 + $25 1S acre $10 each additional acre SECTION 2 In addition to all related costs, including postage, legal notices and court reporter fees, the following fee schedule is hereby adopted for requests brought before the Zoning Board of Appeals: Zoning Variance $150 Special Use Permit New Application $150 Review /Show Cause Hearings $150 Special Hearings Specially Requested Hearings $150 Appeals Administrative decisions $150 SECTION 3 The following fee schedule is hereby adopted for applications and certificate requests made to the Department of Land Use Administration: (verbal response - no charge). Administrative Determination $150 Certificate of Land Use Compliance $50 (as per applicable regulations) Certificate of Nonconformance $50 Certification of Zoning Compliance $50 Cellular Tower Settings $500 Flood Hazard Area Development Permit Determination (building permit) No Charge Permit $25 SECTION 4 In addition to all related costs including postage, legal notices and court reporter fees, the following fee schedule is hereby adopted for applications and certificate requests made to the Historic Preservation Commission: Certificate of Appropriateness $150 Demolition Permit $150 Certificate of Economic Hardship $150 Requests for designated Landmark Historic District Singularly Nominated $150 Specially Requested Hearings (In addition to the regular fee) $150 SECTION 5 Upon a written finding of good cause, the City Manager may waive all or any portion of any fee in this Resolution. SECTION 6. This Resolution shall become immediately effective upon final passage and approval, and shall apply to all applications filed after the close of business Friday, December 27, 2002. SECTION 7. Resolution Number 5073 is hereby repealed as of December 28, 2002.
