A RESOLUTION EXTENDING TIME TO INSTALL LIVING LANDSCAPE MATERIALS
WHEREAS, the Board of Water Works of Pueblo, Colorado ( "Board ") has imposed watering
restrictions on the inhabitants of the City of Pueblo, and
WHEREAS, certain provisions of the Pueblo Municipal Code require installation of living
landscape materials which may use large amounts of water in order to be established, and
WHEREAS, the Executive Director of the Board has requested that required installation of
living landscape materials be suspended by the City. NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
In order to conserve water needed by the inhabitants of the City, the City Council does
hereby direct that upon application approved by the Director of Public Works ( "Director'), the time
to install living landscape materials required pursuant to Section 17-4 -7 of the Pueblo Municipal
Code and /or under a Subdivision Improvements Agreement approved under Section 12 -4 -70) of
the Pueblo Municipal Code, be extended to the date watering restrictions are removed by the
Board.
SECTION 2
No application to extend the installation of living landscape materials shall be approved by
the Director until the applicant enters into an agreement with the City conditioned upon the
applicant (i) completing the required installation of living landscape materials as soon as possible
after date of removal of watering restrictions by the Board, and (ii) furnishing a performance bond,
letter of credit, or other collateral acceptable to the Director to insure the timely installation of living
landscape materials.
SECTION 3
Nothing contained in this Resolution shall be or be construed to be a deferral or extension
of time to perform any other obligation imposed by the Pueblo Municipal Code or any applicable
Subdivision Improvements Agreement, including, without limitation, the obligation to perform
regular and normal maintenance of living landscape material installed prior to the effective date of
this Resolution.
SECTION 4
This Resolution shall become effective upon final passage and approval.
