HomeMy WebLinkAbout09631RESOLUTION NO. 9631 A RESOLUTION GRANTING AN EXEMPTION FROM THE MORATORIUM ON THE ISSUANCE OF PERMITS FOR THE PLACEMENT AND INSTALLATION OF SINGLE FAMILY MANUFACTURED HOMES INDIVIDUALLY OWNED OR TO BE OWNED LOTS WITH FRONT ENTRANCES FACING ADJACENT LOTS AND NOT FACING PUBLIC STREETS WHEREAS, City Council by Resolution and Ordinance imposed a moratorium on the issuance of permits for the placement or installation of single family manufactured homes on individually owned or to be owned lots with front entrances facing adjacent lots and not facing public streets for a period not to exceed four months; and WHEREAS, it has come to City Council's attention that on May 7, 2002, Bruce Michael Cook and Sheri L. Ayers entered into a contract, to purchase a manufactured home to be located at the property at 805 Kalispel Avenue, Pueblo, Colorado, legally described as Lot 29, Block 3, Sunny Heights, Pueblo, Colorado (the "Property "); and WHEREAS, City Council has been informed that one of the buyers, Sheri L. Ayers, has a disability which required the manufactured home to be specifically made with such things as wider doorways and special rest rooms to accommodate Ms. Ayers' wheelchair (the "Manufactured Home "); and WHEREAS, while the Manufactured Home does not have the desired street orientation, it does have windows which face the public street; and WHEREAS, the purchase contract for the Manufactured Home was entered into before the moratorium was imposed and there is no evidence. that such was done to circumvent the intent of the moratorium; and WHEREAS, the Property was previously issued a certificate of nonconforming lot of record on April 10, 2002, which was also before the moratorium was imposed. BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 Due to the -above extenuating and mitigating circumstances Bruce Michael Cook and Sheri L. Ayers are hereby granted an exemption from the moratorium imposed on the issuance of permits for the placement or installation of their single family Manufactured Home on individually owned or to be owned lots with front entrances facing adjacent lots and not facing public streets for the Property. SECTION '2 The Pueblo Regional Building Department is hereby authorized, upon proper application and compliance with the existing codes of the City of Pueblo, to issue permits for the placement and installation of the single family Manufactured Home on the Property.
