A RESOLUTION ACCEPTING A SPECIAL WARRANTY
DEED FROM LT PROPERTIES, INC., A DELAWARE
CORPORATION, FOR PARK PURPOSES
WHEREAS, LT Properties, Inc., the owner of real property described in Exhibit "A" of
a Special Warranty Deed dated February 16, 2001, has granted a deed to the City of Pueblo for
parcels of land totaling 18.937 acres; and
WHEREAS, the land is being deeded to the City to fulfill the park dedication
requirement for the Eagleridge Master Plan (Amended);
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Deed, a copy of which is attached hereto, having been approved as to form by the
City Attorney, is hereby approved and accepted.
SECTION 2.
The City Clerk is directed to cause said deed to be recorded in the office of the Pueblo
County Clerk and Recorder.

ISSUE
Should City Council accept a deed from LT Properties, Inc., to fulfill the park dedication
requirements for LT Properties' holdings within Eagleridge Master Plan ( Amended )
Approval of this Resolution
BACKGROUND
LT Properties, Inc., owns a large tract of land within the Eagleridge Master Plan and is
developing the property in phases. The City's subdivision ordinance requires that the
developer dedicate 8% of residential development land for park purposes. The location
of the proposed park is outside of the boundaries of the plat for the initial phase of the
development ( Eagleridge Estates). Therefore, the developer proposes to deed the land to
the City until such time as the park area and adjacent land is subdivided in the future. At
that time, the park will be dedicated on the subdivision plat. The combined area of the
two parcels is enough to satisfy the entire park dedication requirement for all of LT
Properties' holdings within the Eagleridge Master Plan.

FINANCIAL EWPACT
There is no financial impact to the City from accepting this land. Any improvements on
the property other than park development, such as drainage channels and future roadway,
will be made by the developer per the Subdivision Improvement Agreement_

law or equity, of, in and to the above bargained premises, with the hereditaments and appurtenances.
TO HAVE AND TO HOLD the said premises above bargained and described, with the
appurtenances, unto the grantee, his heirs and assigns forever. The grantor, for himself, his heirs and
personal representatives or successors, do covenant and agree that he shall and will WARRANT AND
FOREVER DEFEND the above - bargained premises in the quiet and peaceable possession of the grantee,
his heirs and assigns, against all and every person or persons claiming the whole or any part thereof, by,
through or under the grantor. The singular number shall include the plural, the plural and the singular,
and the use of any gender shall be applicable to all genders.

LAND DESCRIPTION OF PARK PARCELS:
A parcel of land in the NE 1 /4 and in the SE 1 /4 of Section 11, Township 20 South, Range
65 West of the 6th P.M. in the County of Pueblo and State of Colorado and being more
particularly described as follows:
Considering the East line of the NE 1 /4 of said Section 11 to bear N. 00 0 31'24" W. and all
bearings contained herein being relative thereto.
Beginning at the Northernmost corner of Eagleridge, First Filing, according to the
recorded plat thereof, filed for record September 27, 1982; thence N. 34 0 3739" W., a
distance of 457.49 feet to the South line of a power easement conveyed by easement
recorded in Book 1300 at Page 223 and in Book 1537 at Page 757 of the Pueblo County
records; thence N. 52 0 36'56" E., along said South line, a distance of 595.23 feet; thence
S. 37 0 23'04" E., a distance of 205.09 feet; thence Southwesterly, along the arc of a
