A RESOLUTION APPROVING A LEASE EXTENSION
AGREEMENT BETWEEN THE CITY OF PUEBLO, A
MUNICIPAL CORPORATION AND THE STATE OF
COLORADO ACTING BY AND TROUGH THE
DEPARTMENT OF REVENUE, LOTTERY DIVISION
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Lease Extension Agreement between the City of Pueblo, a Municipal
Corporation and the State of Colorado, acting by and through the Department of
Revenue, Lottery Division, extending the term, modifying the payment arrangements,
and deleting Section 18 of the April 1, 1992 Lease Agreement, a copy of which is
attached hereto, having been approved as to form by the City Attorney, is hereby
approved.
SECTION 2.
The President of the City Council is authorized to execute the lease extension
agreement in the name of the City and the City Clerk is authorized and directed to affix
the seal of the City thereto and attest same.

TITLE
A RESOLUTION APPROVING A LEASE EXTENSION AGREEMENT
BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION AND THE
STATE OF COLORADO ACTING BY AND TROUGH THE DEPARTMENT OF
REVENUE, LOTTERY DIVISION
ISSUE
The Colorado Lottery currently leases 11 ,758 square feet of storage space from
the City of Pueblo. This storage space is located in the City's Public Works
Compound at 211 E. "D" Street.
This lease is scheduled to expire June 30, 2002, and the Lottery has been
noted by the City that is it our intent to terminate the lease as of June 30, 2002.
The Lottery has asked for a two -month extension giving them until August 31,
2002 to vacate the premises.
This agreement will extend the current lease for an additional two months to
expire August 31, 2002.

FINANCIAL IMPACT
The City will generate $2,939.50 in rent for the period July 1, 2002 to August 31,
2002.

AMENDMENT #1 TO LEASE

THIS AMENDMENT #1 TO LEASE, made and entered into this 28th day of May ,
2002, for the purpose of amending that certain lease having Contract Routing No. 93/003, (the "Lease ")
dated July 1, 1992, and the lease extension agreement dated June 26, 1997, Contract Routing No.
98/00005, by and between THE CITY OF PUEBLO, a municipal corporation, as "Lessor", and THE
STATE OF COLORADO, acting by and through the DEPARTMENT OF REVENUE, COLORADO
LOTTERY DIVISION, as "Lessee", relating to the leasing of the Premises known as 11,758 sq. ft.
Storage Space on the ground floor of City of Pueblo Maintenance Shop at 211 East D Street, Pueblo,
Colorado 81003, as noted on Exhibit A (the "Building ").
WHEREAS, as to Lessee, authority exists in the Law and Funds have been budgeted, appropriated
and otherwise made available and a sufficient unencumbered balance thereof remains available for
payment in Fund Number 503, Contract Encumbrance Number - C- 934036 or in the
Account(s) reflected on the attached COFRS printout..
WHEREAS, the Lessor and the Lessee desire to extend the lease an additional two (2) months
beyond the current lease termination date at the monthly rate set forth below; and
WHEREAS, the Lessee has agreed to vacate said premises immediately upon termination of the above
two (2) month extension; and
NOW, THEREFORE, Lessor and Lessee in consideration of the mutual promises contained herein,
hereto agree to amend the Lease as follows:
For the period July 1, 2002 through August 31, 2002, the monthly rental shall be as follows:

Section 18 of said lease is hereby deleted and Lessee shall vacate the leased premises
immediately upon expiration of the extended term.
Except as modified by the provisions of this Amendment #1 to Lease, all other terms and conditions in
the Lease are hereby ratified and confirmed and remain in full force and effect.
In the event of any conflict, inconsistency, variance or contradiction between the provisions of this
Amendment #1 to Lease and any of the provisions of the Lease, the provisions of this Amendment #1
to Lease shall in all respects supersede, govern and control.
A copy of the Lease is attached hereto as Exhibit "ONE ".
In accordance with the requirements of 24 -30 -202 (1) C.R.S., as amended, this Amendment #1 to
Lease shall not be deemed valid until it has been approved by the State Controller, or such assistant
as he may designate.
The effective date of this Amendment #1 to Lease is July 1, 2002.
IN WITNESS WHEREOF, the parties hereto have executed this Amendment #1 to Lease on the
day and year first above written.
