A RESOLUTION APPROVING AN EASEMENT BETWEEN
THE CITY OF PUEBLO, A MUNICIPAL CORPORATION AND
COLORADO INTERSTATE GAS COMPANY AND
AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL
TO EXECUTE SAME
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
The Easement between the City of Pueblo, a municipal corporation and Colorado
Interstate Gas Company relating to a 50 feet by 50 feet parcel of land, a copy of which is
attached hereto, having been approved as to form by the City Attorney, is hereby
approved. The President of the City Council is authorized to execute and deliver the
Easement in the name of the City.
SECTION 2
This Resolution shall become effective upon final passage and approval.

ISSUE
Should the City Council approve the granting of an easement to Colorado Interstate Gas
Company for the purpose of installing a pipeline cleaning and inspection facility.
RECOMMENDATION
Approval of this Resolution.
BACKGROUND
Colorado Interstate Gas Company has requested an easement at the Airport Industrial
Park for the purpose of constructing an inspection and cleaning station over the existing
CIG gas line. The gas line currently lies within an easement, however, the cleaning and
inspection station will extend outside of this easement by a small amount. A letter from
CIG is attached which further explains their need of this easement.
FINANCIAL IMPACT
There is no financial impact associated with the granting of this easement.

KNOW ALL PERSONS BY THESE PRESENTS:
THAT the undersigned, hereinafter called Grantor, whether one or more, in consideration of
the sum of TEN AND MORE DOLLARS ($10.00 and more) and other good and valuable
consideration in hand paid by COLORADO INTERSTATE GAS COMPANY, a Delaware
corporation, hereinafter called CIG, the receipt of which is hereby acknowledged, does grant, sell and
convey unto CIG, its successors and assigns, the right, privilege and authority to construct, operate,
maintain, repair, replace, renew, and remove natural gas meter facilities, pipelines, odorization
facilities, cathodic protection and all other necessary and related facilities for use in connection with
CIG's natural gas pipelines on the following described property situated in the County of Pueblo,
State of Colorado:
A tract of land, 50 feet by 50 feet, in the SW /4 of Section Thirty (30), Township
Twenty South (T20S), Range Sixty -Three West (R63W), Pueblo County, Colorado
and more particularly shown on Plat No. 32BU -3 which is attached as Exhibit "A ".
Grantor further grants unto CIG the exclusive use of the surface of the above described
property with the right to fence the same for the purposes stated above, together with the right of
reasonable ingress to and egress from said property over Grantor's other property at such locations as
Grantor shall designate. All structures placed upon said premises shall, regardless of the character
thereof, remain the personal property of CIG, and shall be removed therefrom at the expiration of
this grant.
By acceptance and recording of this easement, CIG stipulates and agrees that CIG will
indemnify, defend, and hold Grantor harmless from and against any and all claims, expenses,
including reasonable attorney fees, liabilities, loss and damage to property or injury or death of
persons, caused by or arising out of the construction, installations, maintenance or use of the
facilities and the easement hereby granted, except for those claims, expenses, including reasonable
attorney fees, liabilities, loss and damage to property or injury or death of persons, caused by or
arising out of the gross negligence and/or intentional acts of Grantor or Grantor's representatives.
It is agreed that this Easement shall be assignable, in whole or in part; and it is also agreed
that the Easement herein granted to CIG is a perpetual easement, but that the same will revert to
Grantor upon abandonment by CIG.

Dear Mr. Cvar:
Colorado Interstate Gas Company (CIG) is requesting an easement from the City
of Pueblo per amended Plat No. 32BU -3 provided to you. The proposed construction at
this site will consist of above ground block valves and 2" crossover which CIG
designates as Gate 2 on the above referenced pipeline. This site is to be built
approximately 68' east of the existing block valve assembly. The existing assembly will
be removed in its entirety during construction of the new site.
The two primary reasons for this replacement are as noted below by our Project
Engineer, Russ Council:
1. The existing reduced port plug valve must be replaced with a full port ball valve
to allow the passing of an internal inspection tool (aka intelligent pig). The intelligent pig
is an instrument used in the pipeline industry to identify existing pipe wall thickness.
2. The new location allows better access for CIG Operations maintenance activities,
primarily by moving away from the drainage area on the north side of the existing
location.
The majority of the new location is located on the existing Right of Way for the
two pipelines present on the property. The center of the requested easement is
approximately 19' west of the point where one line (the 32A -8 ") turns north and feeds
CIG's Pueblo Airbase Meter Station. The site is —130' south of the existing Airbase
Meter Station, and was moved slightly north in order to avoid construction on the BNSF
Right of Way.
Insofar as sight screening is concerned, CIG intends to put beige, vinyl slats in the
wire mesh fence to be built on the outside boundaries of the requested easement. We are

reluctant to plant any trees at this site due to the close proximity of the BNSF Right of
Way and the location of the new electric substation in relation to our existing pipelines.
I would be happy to conduct a site visit with you and/or any other representatives
of the City to give you a better idea of site location and need for moving same to the east
of the existing block valves. Thank you for your time and effort in regard to the above.

Landscaping Commitment

Per our conversation of April 3, 2002 in regard to landscaping at Pueblo Air Base
Meter Station, ( PABMS), please be advised of the following commitments:
1. Colorado Interstate Gas Company (CIG) will also install beige vinyl slats on
the north, west and east portions of the fence that surrounds PABMS in
addition to installing these slats on the fence surrounding the requested
easement for new block valve assembly.
2. CIG will plant trees on the north side of PABMS between the north meter
station perimeter and United Avenue subject to the following:
a. PABMS is the transfer point between CIG and Public Service
Company of Colorado (PSCO) which delivers gas to the businesses
at Pueblo Memorial Airport, etc. The PSCO lines extend out from
PABMS to various delivery points. Any tree planting within the
vicinity of PSCO's lines must be subject to complete approval from
PSCO. Any tree planting is also subject to approval from any other
public utility or entity that may have existing rights in this vicinity.
CIG cannot guarantee approval from PSCO, or any other entity that
has existing rights in this area.
b. CIG must receive written permission from the City of Pueblo (City)
to plant said trees within and on City property and/or any City Right
of Way.
