VEYING TO THE PUEBLO CITY - COUNTY LIBRARY
DISTRICT THE CITY OF PUEBLO'S INTEREST AND TITLE
IN AND TO THE McCLELLAND LIBRARY AND BUILDING
AND AUTHORIZING THE PRESIDENT OF THE CITY
COUNCIL TO EXECUTE SAME
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
The Quitclaim Deed dated March 25, 2002 conveying to the Pueblo City- County
Library District the City's title and interest in and to the McClelland Library land and
building, a copy of which is attached hereto, having been approved as to form by the City
Attorney, is hereby approved.
SECTION 2
The President of the City Council is authorized to execute and deliver the Quitclaim
Deed in the name of the City and the City Clerk is directed to affix the seal of the City
thereto and attest same.

ISSUE
Should the City Council approve the Resolution authorizing the transfer of the
McClelland Library land and building to the Pueblo City - County Library District?
RECOMMENDATION
None.
BACKGROUND
The City owns the McClelland Library land and building which is being used by the
Pueblo City - County Library District. The District has requested the City to transfer
title to the land and building to the District for the purposes of its expansion project.
The District's use of the land and building is pursuant to a 1969 agreement whereby
the City granted permission for such use so long as the District maintains and
provides library services, which in the opinion of the City Council, are adequate to
serve the residents of the City. The Quit Claim Deed Contains a reverter clause. If
the land and building cease being used by the Pueblo Library District, it will revert
back to the City.
FINANCIAL IMPACT
The City will not receive any funds as payment for the land and building being
transferred, otherwise, no financial impact.

EXHIBIT "A"
LEGAL DESCRIPTION
A parcel of land being the unnamed triangle block and located directly
northwest of Block Q both within South Pueblo according to the recorded
plot thereof filed for recorded December 13, 1872 in Book 2A at Page 4 of
Plats within the records of the Pueblo County Clerk and Recorder and being
a portion of the S 112 of the SW 114 of Section 36, Township 20 South,
Range 65 West of the Sixth Principal Meridlon, being more particularly
described as follows:
BEGINNING at the northwesterly corner of the intersection of Abriendo Avenue
and Newton Avenue said . point also . being the most southerly corner of said
unnamed tract, from which the City Reference Monument for the intersection
of Broad way Avenue and said Abriendo Avenue bears S 17' 13'35 "E (Beorings
based on the line from the said City Reference Monument for the intersection
of Broadway Avenue and Abriendo Avenue to the City Reference Monument for
the intersection of Church Place and Main Street monumented at each end
with a concrete monument with lead and brass tack in a cost iron
monument box, assumed to bear N 74'50'50 "E) a distance of 175.50 feet;

Abriendo Avenue a distance of 305.23 to a point on the southeasterly corner
