HomeMy WebLinkAbout09564"As Amended 3/25/02" RESOLUTION NO. 9564 A RESOLUTION AUTHORIZING THE ISSUANCE OF A REVOCABLE PERMIT FOR INSTALLATION AND MAINTENANCE OF LANDSCAPING IN THE PUBLIC RIGHT -OF- WAY ALONG NORTH ELIZABETH STREET AND 602 WEST 9TH STREET BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. A revocable permit be issued to Susan Pacheco in conformance with his application dated March 4, 2002, a copy of which is attached and made a part hereof by reference to install landscaping in the public right -of -way along North Elizabeth and 602 West 9 Street, Pueblo, Colorado, legally described as Lots I and 2, Block 46, of the County Addition to City of Pueblo, Amended Plat. SECTION 2. With the recommendations of the Department of Community Development, the designated review agency, this revocable permit is approved with the following conditions: 1. Landscape the right of way between the property and curb and gutter on North Elizabeth Street and along 602 West 9 Street. 2. In addition to the approved ten -foot landscape on right of way, provide a parking lot screen back of sidewalk. SECTION 3. The revocable permit, hereby granted, may be revoked by resolution of the City Council at anytime hereafter without notice. SECTION 4 Issuance of the Revocable Permit is contingent upon the applicant submitting a revised landscaping plan that meets the City's Landscaping Ordinance. RECOMMENDATION Denial of this Resolution BACKGROUND Susan Pacheco, owner of the property located at 602 West 9th Street has requested a revocable permit for the use of public right -of -way to satisfy all or part of the Landscape Performance Standards. The entire ten -foot setback is on public right -of way and an additional three feet will be landscaped on property. The owner's reason for this request is to provide area between the building and the sidewalk for parking. The owner has agreed to provide a parking lot screen on the back of sidewalk in addition to the requirement on the right of way. The property owner understands if the roadway is widened in the future and the required landscape on the right -of -way is eliminated or reduced, the property owner will have to replace the landscape on the property. The City's Designated Review Agent for landscape has signed -off on the permit with condition of the approval of the revocable permit. This sign -off was done prior to the administrations recent policy not to allow a revocable permit on a minor arterial street such as Elizabeth Street. Ninth Street is a local street. The building has been constructed and the parking layout has been approved by staff. The owner has provided the landscape plan for the conditions by the Designated Review Agent, except for the revocable permit (See landscape plan). FINANCIAL IMPACT No Financial Impact
