A RESOLUTION APPROVING CONTRACT CHANGE
LETTER NO. 1 TO ENERGY IMPACT ASSISTANCE FUND
CONTRACT NO. 4155, PUEBLO ADMINISTRATIVE INTERN,
BY AND BETWEEN THE STATE OF COLORADO FOR THE
USE AND BENEFIT OF THE DEPARTMENT OF LOCAL
AFFAIRS AND THE CITY OF PUEBLO AND AUTHORIZING
THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME
WHEREAS, the Department of Local Affairs wishes to fund the Pueblo Administrative
Internship Program for a second year, 2003, and has delivered to the City contract change letter
No. 1 modifying the budget of EIAF Contract No. 4155 to reflect additional funding for the
second year.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:

Contract Change Letter No. 1 modifying the time of performance and budget of EIAF
Contract No. 4155, a copy of which is attached hereto and incorporated hearing having been
approved as to form by the City Attorney is hereby approved.
SECTION 2.
The President of City Council is hereby authorized to execute and deliver said Contract
Change Letter in the name of and on behalf of the City of Pueblo, a Municipal Corporation, and
the City Clerk shall affix the seal of the City thereto and attest same.

PUEBLO AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE
SAME
ISSUE
Shall the City Council enter into a Contract with the Department of Local Affairs to fund
the expenses associated with the procurement of public administrative services for the
Bessemer Neighborhood for an additional year, 2003.
RECOMMENDATION

BACKGROUND
The City of Pueblo, Pueblo County, Colorado Department of Local Affairs, Bessemer
Neighborhood Association, Minnequa Redevelopment Corporation, and the Bessemer
Historical Society have joined together to form the Bessemer Neighborhood Partnership.
The Colorado Department of Local Affairs has agreed through the Best and Brightest
Internship Program to fund an Administrative Intern position to provide the partnership
with administrative support. The Best and the Brightest Internship Program is a joint
program of the University of Colorado at Denver and the Department of Local Affairs in
which students work full time in communities or neighborhoods and attend graduate
classes on weekends. This is a two -year program. The students are paid an annual salary
of $21,000, which includes their tuition. The Bessemer Historical Society, because they
are incorporated as a nonprofit corporation, has agreed to be the service provider under this
Contract for the Bessemer Neighborhood Partnership. The City and the Society have
entered into a separate subdelegation agreement to provide these services for calendar year
2002. This Contract Change Letter will provide $21,500 in funding for the second year.
The City will enter into a second subdelegation agreement with either the Bessemer
Historical Society or directly with the Bessemer Neighborhood Partnership, should they
become incorporated as a nonprofit corporation for 2003. Any match requirement in the
second year will be the responsibility of Bessemer Neighborhood Partnership.
FINANCIAL IMPACT
The Department of Local Affairs will provide $21,500 to fund the Pueblo Administrative
Internship Program for an additional year, 2003. The total cost of the program is $31,500.
The additional $10,000 will be the responsibility of the Bessemer Neighborhood
Partnership. A subdelegation agreement for 2003 will be entered into with either the
Bessemer Historical Society or the Bessemer Neighborhood Partnership, should they
incorporate as a nonprofit corporation prior to the execution of the agreement.
Funding from DOLA for 2002 will come from the Community Service Block Grant
Program. These are Federal funds. There is a provision of the Contract, 6(b), which
states: "It is expressly understood that if the Contractor receives funds from this Contract
in excess of its fiscal year spending limit all such excess funds from this Contract shall
revert to the State. Under no circumstances shall excess funds from this Contract be
refunded to other parties."

THIS CONTRACT CHANGE LETTER NUMBER #1, made this day of
2002, by and between the State of Colorado for the use and benefit of the Depart ment of Local Affairs,
1313 Sherman Street, Denver, Colorado 80203 hereinafter referred to as the State, and the City of
Pueblo P.O. Box 1427 Pueblo, Colorado 81002 , hereinafter referred to as the Contractor,
WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise
made available and a sufficient unencumbered balance thereof remains available for payment in Fund
Number 153 , Appropriation Code Number 127 , Org. Unit F1300 , GBL 2M14 , Contract Encumbrance
Number F02MLG4155 ; and
WHEREAS, this Change Letter modifies Contract # F02MLG4155 , Routing # 00590 , dated
January 1, 2002 , and both the State and the Contractor are agreeable to this contract modification,
THEREFORE, this Contract, hereinafter referred to as the Original Contract, is changed as follows:
1. Exhibit A, Scope of Services, "3. Time of Performance ", is modified by deleting " December 31,
2002 " and inserting in lieu thereof " December 31. 2003 ".
2. Exhibit A, Scope of Services, "4. Budget is modified as follows:

By affixing their signatures to this change letter, both the State and the Contractor expressly
acknowledge that all of the terms and conditions of the Original Contract remain unchanged except for those
terms and conditions modified by this Change Letter # 1 and all previous changes. Both parties also
expressly understand that this Change Letter # 1 is incorporated into the Original Contract.
This Contract Change Letter Number # 1 is intended to be effective as of
but in no event shall it be deemed valid until it shall have been approved by the State Controller
or such assistant as he may designate.
