A RESOLUTION APPROVING A MEMORANDUM OF
UNDERSTANDING BETWEEN THE CITY OF PUEBLO, A
MUNICIPAL CORPORATION, AND PUEBLO COUNTY
REGARDING THE WEATHERIZATION PROGRAM, AND
AUTHORIZING EXECUTION OF SAME BY THE
PRESIDENT OF THE CITY COUNCIL
WHEREAS, City and County have heretofore entered into an Agreement dated
June 26, 2000 (the "Agreement ") under which they formed a consortium for the purpose
of receiving certain federal funds and undertaking housing assistance activities pursuant
to the HOME Investment Partnerships Program, in accordance with the provisions of
said Agreement; and
WHEREAS, pursuant to the Agreement and the Consolidated Plan, the City and
County each conduct programs designed to address housing, homeless and supporting
need within the City, including rehabilitation loan programs under which HOME and /or
Community Development Block Grant ( "CDBG ") funds are loaned to qualifying low or
moderate income persons for the purpose of rehabilitating owner occupied single family
housing to render same clean, safe and sanitary. Such rehabilitation work may include,
but is not limited to, replacement of defective furnaces, electrical repairs, plumbing
repairs and roofing and ceiling repairs; and
WHEREAS, using funds available from the Energy $aving Partners Program
provided by the Colorado Office of Energy Management and Conservation ( "OEMC "),
the County conducts a weatherization program ( "County's Weatherization Program ")
designed to address housing weatherization needs for qualified low and moderate
income persons; and
WHEREAS, County encounters clients of County's Weatherization Program who
are in need of certain rehabilitation work, including furnace replacement, electrical
repairs, plumbing repairs or roof and ceiling repairs prior to installation of emergency
conservation measure under its Program; and
WHEREAS, City and County desire to coordinate their activities with respect to
the provision of such repair services for clients of County's Weatherization Program in
order to enhance the effectiveness of both County's Weatherization Program and the
City's Program; and
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Memorandum of Understanding dated January 28, 2002, between the City of
Pueblo, a Municipal Corporation and Pueblo County ( "MOU ") concerning the
Weatherization Program, a true copy of which is attached hereto and incorporated
herein by reference, having been approved as to form by the City Attorney, is hereby
approved.
SECTION 2.
The President of the City Council is hereby authorized to execute the MOU on
behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk is directed to
affix the seal of the City thereto and attest same.

TITLE
A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING

PUEBLO COUNTY REGARDING THE WEATHERIZATION PROGRAM, AND
AUTHORIZING EXECUTION OF SAME BY THE PRESIDENT OF THE CITY
COUNCIL
ISSUE
Request approval of a Memorandum of Understanding between the City of
Pueblo and Pueblo County allowing City residents, not eligible for the County
Weatherization measures due to faulty mechanical systems, to access City
rehabilitation funds for the repair of said systems. The Agreement would allow
the County's qualified and licensed employees to complete the necessary
rehabilitation work, before the installation of energy conservation measures.
RECOMMENDATION
Approve the Memorandum of Understanding allowing the County to provide to,
otherwise non - eligible City residents, necessary repairs allowing weatherization
work to proceed.
BACKGROUND
This Agreement will renew an Agreement between the City and County whereby
the City will provide CDBG /HOME funds to make the necessary major repairs as
required under the Department of Energy's E$P Program regulations to a City
resident's home. These repairs must be completed with non - Energy $avings
Partners Program (E$P) funds. The Weatherization Program guidelines provide
for only $150 per home to cover costs for major electrical repairs and other
mechanical systems. If these systems are not up to housing codes, the County
"walks" from the project, thereby very low income families unable to afford the
repairs are not able to access the Weatherization Program benefits.
Historically, the Program has assisted 95 City households, at an average cost of
$552. Eligible households must be at or below 185% of the poverty index to
qualify for the program or receive cash assistance under Title IV or Title XVI of
the Social Security Act. The poverty index is $8589 per year for one person.

FINANCIAL IMPACT
The City would set -aside $25,000 out of its Housing Rehabilitation funds to meet
its obligations under this Agreement.
MEMORANDUM OF UNDERSTANDING
CONCERNING WEATHERIZATION PROGRAM
REQUIRED REHABILITATION WORK
THIS MENORANDUM OF UNDERSTANDING is made and entered into this
28th day of January, 2002, by and between the City of Pueblo, a Municipal Corporation
(hereafter referred to as the "City") and Pueblo County, Colorado for and on behalf of its
Department of Housing and Human Services (hereafter referred to as the "County").
WITNES SETH:
WHEREAS, City and County have heretofore entered into an Agreement dated

WHEREAS, the parties desire to set forth in this memorandum their mutual
understanding concerning such coordination, and in furtherance of the Agreement;
NOW, THEREFORE, in consideration of the foregoing recitals and mutual
covenants and promises contained herein, the parties agree as follows:

1. The City commits to allocate Twenty -Five Thousand Dollars ($25,000.00) of
unencumbered and available Community Development Block Grant (CDBG) funds, which
are available for expenditure by City's Department of Housing and Citizen Services for
housing rehabilitation, for use in undertaking the necessary rehabilitation work (the
"Weatherization Related Rehabilitation Work ") as provided under this Memorandum
which should be performed before installation of energy conservation measures by the
County (the "City's Weatherization Repairs Allocation "). County shall likewise allocate
Twenty -Five Thousand Dollars ($25,000.00) of unencumbered and available funds
provided by or through the Colorado Office of Energy Management and Conservation for
Weatherization Related Rehabilitation Work (the "County's Weatherization Repairs
Allocation ")
2. The funds identified as City's and County's Weatherization Repairs Allocation
shall be expended only for the Weatherization Related Rehabilitation Work consisting of
the following categories of approved work:
a. Furnace Replacements -A furnace replacement is an allowable cost when
the heating unit has an identified crack in the heat exchanger.
b. Electrical Repairs - Repair work necessary before the installation of attic
or sidewall insulation.
c. Plumbing Repairs Repair work necessary before the installation of
floor, perimeter, or sidewall insulation.
d. Roofing Repairs Repair work necessary before the installation of attic
or sidewall insulation, or approved air leakage work.
e. Ceiling Repairs Repair work necessary before the installation of attic
insulation or air leakage work.
3. Expenditures from the Weatherization Repairs Allocation shall only be made
for households which meet the following eligibility criteria:
a. Households of low- income families at or below 185% of the Federal
Poverty Index who have been approved in the present program year for
basic Low - Income Energy Assistance Program (LEAP) funds, or
b. Households of low- income families whose total gross family income for
the entire twelve months preceding the date of eligibility determination
is at or below 185% of the poverty level determined in accordance with
the Federal Poverty Income Guidelines for 2001, or

c. A household includes a member who is receiving cash assistance under
Title IV or Title XVI of the Social Security Act. These programs
pertain to the following:
(1) TANF — The Aid to Needy Families,
(2) WIN — Work Incentive Program
(3) SSI — Supplemental Social Security Income
(4) OAP — Old Age Pension, or
(5) AND — Aid to Needy Disabled.
4. The City's Weatherization Allocation shall be expended only for
Weatherization Related Rehabilitation Work on owner - occupied, single - family residences
located within the City, with the expenditure per home not to exceed Eight Hundred
Dollars ($800.00). The County's Weatherization Allocation shall be expended for
Weatherization Related Rehabilitation Work in the unincorporated areas of Pueblo County
and within Region II, as set forth by OEMC. At the County's discretion, the funds can be
expended within such areas and within the City of Pueblo with the expenditure per home
not to exceed Eight Hundred Dollars ($800.00)
5. County's Department of Housing and Human Services ( "HHS ") shall determine
eligibility for assistance of all applicants for funds from both City's and County's
Weatherization Repairs Allocation. Any appeals from eligibility determinations shall be
heard and determined in accordance with administrative procedures established by County
for such purpose.
6. The City and County shall make funds available for such repair work by a grant
to the applicants approved to receive assistance ( "Participants ").
7. HHS shall maintain a record of all expenditures in accordance with the audit
requirements of OEMC.
8. Participants in the Weatherization Repairs Allocation shall abide by the
County's Weatherization Contracts as approved by the Board of County Commissioners
through Resolution #01 -189 for Materials and Services for Program Year 2001 -2002.
9. County shall not commence any Weatherization Related Rehabilitation Work
for a Participant until and unless a signed agreement ( "Weatherization Application ") has
been entered into between the County and the Participant.
10. City's Director of Housing and Citizen Services and County's Director of
Housing and Human Services are authorized and directed to cooperate in implementing the
intent of this Memorandum.
11. This Memorandum shall become effective as a supplement to the Agreement
immediately upon approval by the respective governing bodies of each of the parties, and
shall terminate on September 30, 2002. All unencumbered funds identified to the

Weatherization Repairs Allocation and existing on September 30, 2002 shall thereupon
automatically cease to be so allocated for such purposes and may be reallocated by City or
County, as the case may be, in any manner permitted by law.
12. Except as modified and supplemented by this Memorandum, all of the
provisions set forth in the Agreement shall continue in full force and effect and shall apply
to the conduct of the activities undertaken with Weatherization Repairs Allocation.
IN WITNESS WHEREOF, the parties have entered into this Agreement the day
and year first written above.
