A RESOLUTION AWARDING A CONSTRUCTION
CONTRACT IN THE AMOUNT OF $591,713 TO BYERLY &
COSYLEON, INC., AND SETTING FORTH $98,394 FOR
CONTINGENCIES, FOR THE HISTORIC ARKANSAS
RIVERWALK OF PUEBLO — PHASE IIC BOETTCHER
OUTDOOR EDUCATION CENTER, AND AUTHORIZING
THE PURCHASING AGENT TO EXECUTE THE SAME
WHEREAS, bid proposals for the Historic Arkansas Riverwalk of Pueblo — Phase
Ilc Boettcher Outdoor Education Center have been received and examined; and
WHEREAS, the bid proposal from Byerly & Cosyleon, Incorporated, of Pueblo,
Colorado was lowest of those bid determined to be responsible,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
A contract for the Historic Arkansas Riverwalk of Pueblo — Phase Ilc Boettcher
Outdoor Education Center project is hereby awarded to Byerly & Cosyleon, Inc. in the
amount of $591,713.
SECTION 2.
The Purchasing Agent is hereby authorized to execute said contract on behalf of
the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the
City thereto and attest the same.
SECTION 3.
In addition to the amount of the bid set forth, as aforementioned, an additional
amount of $98,394 shall be established for contingencies and additional work.
SFCTION 4
Funds for said project shall be from the HARP Fund.

Approval of this Resolution.
BACKGROUND
The City of Pueblo received bids for construction of the HARP -Phase IIc — Boettcher
Outdoor Education Center project. The project's base bid included a restroom /lab
building, a canopy over the existing outdoor amphitheatre, retaining walls, the historical
"Pike's Plaza ", and landscaping. The project also included several bid alternates, which
consist of completing the sidewalk along the channel east of Main Street, installation of
railing at 3 locations, installation of the historic light fixtures, adjustments to existing

building, a canopy over the existing outdoor amphitheatre, retaining walls, the historical
"Pike's Plaza ", and landscaping. The project also included several bid alternates, which
consist of completing the sidewalk along the channel east of Main Street, installation of
railing at 3 locations, installation of the historic light fixtures, adjustments to existing
light fixtures, and the installation of tree grates in front of City Hall. The following is a
break down of the bid costs:

Construction of the project will be administered through the City's Public Works
Department.
FINANCIAL IMPACT
Funds for this project will be paid from two different sources. The Base Bid plus its
contingency, totaling $550,106.50, will be paid with funds from the HARP Foundation
per Resolution No. 9200. The Alternates plus its contingency, totaling $140,000.50, will
be paid from the City's HARP Fund Balance. Attached is a bid summary of the base bid
with selected alternatives and a bid summary showing the entire bid.
