HomeMy WebLinkAbout09436RESOLUTION NO. 9436 A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE WITH COLORADO REVISED STATUTES SECTION 31 -12- 107 (1) OF THE PETITION FOR ANNEXATION OF THE AREA COMMONLY KNOWN AND DESCRIBED AS 2335 I -25 NORTH WHEREAS, a Petition For Annexation of the area described in Section 1 hereof has been filed with the City Clerk, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Petition For Annexation of the following described area situated in Pueblo County, Colorado, is hereby found and determined to be in substantial compliance with the provisions of C.R.S. §31 -12 -107 (1): LEGAL DESCRIPTION OF AREA TO BE ANNEXED TO THE CITY OF PUEBLO: All that portion of the N 1/ 2 of the NW 1/4 of Section 1, Township 20 South, Range 65 West, of the 6 P. M. described as follows: Commencing at a point where the South Line of the N 1/ 2 of the NW 1/4 of Section 1, intersects the West boundary line of the U. S. Highway 85 -87 right -of -way; thence North along said West boundary line of the U. S. Highway 85 -87 right -of -way a distance of 300 feet to a point; thence West and parallel to the South line of the N 1/2 of the NW 1/4 of Section 1, a distance of 450 feet to a point; thence South and parallel to the West boundary line of the U.S. Highway 85 -87 right -of -way a distance of 300 feet to a point on the South line of the N 1/2 of the NW 1/ 4 of Section 1; thence East along the South line of the N 1/2 of the NW 1/ 4 of Section 1, a distance of 450 feet to the point of beginning. EXCEPT that part conveyed to the Department of Highways recorded May 19, 1960 in Book 1420 at Page 1420 at Page 213. TOGETHER WITH A tract of land in the SE1 /4 of the NW 1/4 of Section 1, Township 20 South, Range 65 West of the 6 t P. M., lying west of the right -of -way of the Department of Highways, State of Colorado, Interstate 25, as presently located and being more particularly described as follows: Beginning at the Northwest corner of the said SE 1/4 of the NW 1/4 of Section 1; thence N 88° 27' 30" E, and along the north line of the said SE 1/4 of the NW 1/ 4, a distance of 232.40 feet, to a point on the west right -of -way line of Interstate 25, as presently located; thence southerly, along the west line of the said right -of -way line as presently located, S 14° 03' 10" E, a distance of 25.61 feet; thence S 88° 27' 30" W, a distance of 241.24 feet, to the west line of the said SE 1/4 of the NW 1/4; thence N 05° 57' 30" E, along the said west line of the SE 1/4 of the NW 1/4 , a distance of 25.22 feet, to the Northwest corner thereof, and the point of beginning. Said parcel contains 2.0 acres, more or less. SECTION 2. A public hearing to determine if the area proposed to be annexed meets the applicable requirements of C.R.S. §31 -12 -104 and C.R.S. §31 -12 -105 to establish eligibility for annexation under the Municipal Annexation Act of 1965 shall be held before the City Council in Council Chambers, Second Floor, City Hall, One City Hall Place, Pueblo, Colorado on Monday, January 28, 2002, commencing at 7:00 p.m. or as soon thereafter as City Council business allows. The City Clerk shall publish notice of the public hearing once a week for four successive weeks in the Pueblo Chieftain. The first publication of such notice shall be at least thirty (30) days prior to the date of the hearing. A copy of the published notice, together with a copy of the Petition for Annexation, shall be sent by registered mail by the City Clerk to the Board of County Commissioners and the County Attorney of Pueblo County and to any school district or special district having territory within the area to be annexed at least twenty five days prior to the date of the hearing.
