A RESOLUTION AUTHORIZING THE TRANSFER OF REAL PROPERTY
AT 207 NORTH VICTORIA AVENUE TO THE STATE OF COLORADO,
STATE HISTORICAL SOCIETY OF COLORADO
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1
The Quit Claim Deed from Pueblo, a Municipal Corporation to the State of Colorado, State
Historical Society of Colorado, a copy of which is attached hereto and incorporated herein, having
been approved as to form by the City Attorney, is hereby approved.
SECTION 2:
The President of City Council is hereby authorized to execute and deliver the Quit Claim
Deed in the name of the City and the City Clerk is directed to affix the seal of the City thereto and
attest same.

ISSUE
Should the City Council authorize the transfer of real property to the State of Colorado, Colorado
Historical Society for the El Pueblo Museum expansion project?
RECOMMENDATION
Approval of this Resolution.
BACKGROUND
The El Pueblo Site Development Master Plan has been completed. The Project consists of the
development of the entire block surrounded by First Street, Grand Avenue Victoria Avenue, and
Union Avenue. The development components include: expansion of the museum; construction
of an adobe trading post/fort; construction of an archaeology pavilion; development of a
park/plaza; and completion of right -of -way improvements.
The Museum Expansion Plans consists of the construction of the new El Pueblo museum.
Demolition has occurred of the City owned vacant building purchased from Tony Bacino Trust
(Traffic School) located at 207 N. Victoria Avenue. The City of Pueblo acquired the building in
January 2001 with Capital Outlay Funds in the amount of $160,000. The State of Colorado paid
for the demolition of the building as part of the old museum demolition.
The timing of the transfer of this property to the State is critical and urgent to assure the start of
construction by the end of November of this year Enclosed please find a copy of the Quit

QUIT CLAIM DEED
THIS DEED, made as of the 12th day of November, 2001 between City of Pueblo, a
Municipal Corporation, of the first part, and State of Colorado, State Historical Society of Colorado,
a Colorado nonprofit corporation, of the second part,
WITNESSETH, That the said party of the first part, for and in consideration of the sum of
Ten Dollars ($10.00) to the said party of the first part in hand paid by the said party of the second
part, the receipt whereof is hereby confessed and acknowledged, hath remised, released, sold,
conveyed and QUIT CLAIMED, and by these presents doth remise, release, sell, convey and QUIT
CLAIM unto the said party of the second part, its successors and assigns forever, all of the right, title,
interest, claim and demand which the said party of the first part hath in and to the following
described real property situate, lying and being in the County of Pueblo and State of Colorado, to
wit:
The East 22 feet of Lot 8 and the West 22 feet of Lot 9, Block 43, City of Pueblo, County of
Pueblo, State of Colorado.
commonly known as 215 N. Victoria, Pueblo, Colorado, 81003.
Documentary Fee - none, exempt
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and
privileges thereunto belonging, or in anywise thereunto appertaining, and all the estate, right, title,
interest and claim whatsoever, of the said party of the first part, either in law or equity, to the only
proper use, benefit and behoof of said part of the second part, his heirs and assigns; provided that
the party of the first part conveys the above described real property to the party of the second part
so long as the real property is used exclusively and solely for a public museum or other public
facility in furtherance of the mission of the party of the second part, and no longer, and whenever
the real property ceases to be so used, the estate hereby granted will automatically terminate and title
to the real property will immediately revert to the first party, its successors and assigns. Grantee
takes said right, title and interest of said party of the first part subject to all liens, encroachments and
environmental conditions, including both those of record and those not of record.
IN WITNESS WHEREOF, The said party of the first part hath caused its corporate name to
be hereunto subscribed by the President of the City Council of Pueblo, and its corporate seal to be
hereunto affixed, attested by .its..City Cleric, the day and year first above written.
