HomeMy WebLinkAbout09397RESOLUTION NO. 9397 A RESOLUTION APPROVING THE DESIGN AND INSTALLATION OF THE SUMMER SHOWERS FOUNTAIN IN THE HISTORIC ARKANSAS RIVERWALK OF PUEBLO WHEREAS, the Historic Arkansas Riverwalk of Pueblo Authority is created and organized as a separate legal entity whose power of authority includes the review and recommendation to the City Council for the use, development, construction, installation, removal, and renovation of Public Land and disposition of funds available therefor; and WHEREAS, the HARP Authority has contracted with and evaluated the Design prepared by Design Studios West, Inc., for the Summer Showers Fountain in the Historic Arkansas Riverwalk of Pueblo; and WHEREAS, the HARP Authority has contracted with the firm of H. W. Houston Construction Company for the installation of the Summer Showers Fountain. NOW, THEREFORE, BE IT RESOLVED by the City Council that: SECTION 1 The design and installation of the Summer Showers Fountain, as recommended by the HARP Authority, a copy of the plan which is attached hereto and incorporated herein, is hereby approved. RECOMMENDATION Approval BACKGROUND Please see attached HARP Authority Memorandum dated September 17, 2001. FINANCIAL IMPACT The HARP Foundation is funding the design and installation of the "Summer Showers" Fountain. Operations and maintenance of the fountain will be the responsibility of the HARP Authority. Under the Intergovernmental Agreement which created the Authority, "the parties (except for the Water Board) declare their present intention and expectation to annually appropriate and budget a pro-rata equitable share of the expenses in excess of revenues." The City's proportional share is fifty (50) percent. Water for the Fountain is provided by the Board of Water Works per the Intergovernmental Agreement. This project is one of the program elements identified within the Natural Area for HARP Phase I I C, Element No. 4, Major Art Node Water Feature. Additionally, the plans for it have been reviewed and approved by appropriate city staff and the staff of the Board of Water Works. It is a visually stimulating trio of sculptures, two of which will interact by shooting water at each other at scheduled times throughout the day. The third sculpture will simultaneously project a shower of water upward. "Summer Showers" is made possible through the efforts of the HARP Foundation and DD Marketing, who procured funding for the project via the generosity of three donor entities; Mr. And Mrs. Jerome Crane, Mr. And Mrs. Mahlon T.
